HomeMy WebLinkAboutResolution No. 88380 0 RESOLUTION NO. 8838 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REVOKING CONDITIONAL USE PERMIT NO. C-196 ISSUED TO FRATERNAL ORDER OF EAGLES, NO. 2810 THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. On September 7, 1977, the City issued Conditional Use Permit No. C-196 to the Fraternal Order of Eagles (Eagles Lodge) to operate a bicycle motocross (BMX) facility on the property located at 1603 North San Gabriel Canyon Road. B. On July 12, 1989 and again on August 16, 1989, the Planning Commission held hearings to review Conditional Use Permit No. C-196 due to complaints received by the City from neighbors of the BMX Track. The complaints included issues of noise, dust, traffic and litter. C. At the second hearing on August 16, 1989, the Eagles Lodge testified that the lease with the track operators was to be terminated and operations of the track closed. After the track was closed on November 15, 1989, the Planning Commission directed staff to begin proceedings to revoke the conditional use permit under the provisions of Section 19.60.154(4) of the Azusa Municipal Code. This provision states that a conditional use permit may be revoked if the use for which the permit was granted has ceased. D. On February 14, 1990, the Planning Commission held a duly noticed public hearing on whether to revoke Conditional Use Permit No. C-196. By Resolution No. 90-27, the Planning Commission recommended to the City Council that Conditional Use Permit No. C-196 be revoked. E. On March 19, 1990, the City Council of the City of Azusa held a duly noticed public hearing to consider revocation of Conditional Use Permit No. C-196. The Council received evidence presented by the staff, however, no person representing the property owner, Eagles Lodge, was present to testify. The property owners had indicated to the staff that they did not object to the revocation of this conditional use permit. SECTION 2. Having considered all of the oral and written evidence presented to it at said public hearing, the City Council hereby further finds, determines and declares that: A. The use for which Conditional Use Permit No. C-196 was issued, for the bicycle motocross facility, has ceased and the property is no longer being used for that purpose. B. The property owners have consented to the revocation of Conditional Use Permit No. C-196. SECTION 3. Based on the findings set forth above, the City Council of the City of Azusa hereby revokes Conditional Use Permit No. C-196. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
