RESOLUTION NO. RR21
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA APPROVING CONDITIONAL USE
PERMIT NO. C-89-21 AND PRECISE PLAN OF
DESIGN P-89-204 FOR THE PROPERTY LOCATED
AT 347 SOUTH IRWINDALE AVENUE (DELORES
BOWERS AND CLARENCE CHIAPUZIO)
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. An application was filed by Delores Bowers and
Clarence Chiapuzio for a conditional use permit and
precise plan of design for a bar located at 347
South Irwindale Avenue ("Subject Property").
B. A duly noticed public hearing on the
application for the conditional use permit and the
precise plan of design was held by the Planning
Commission of the City of Azusa on November 29,
1989 and, after considering all of the evidence
submitted with respect to the application, the
Planning Commission adopted Resolution No. 89-94
approving the conditional use permit subject to
certain conditions of approval and adopted
Resolution No. 89-95 approving the precise plan of
design also subject to certain conditions of
approval.
C. On December 18, 1989, the applicants duly
filed a timely appeal from the action of the
Planning Commission challenging certain conditions
of approval on both the conditional use permit and
the precise plan of design.
D. On February 5, 1990, the City Council of the
City of Azusa held a duly noticed public hearing on
the conditional use permit and precise plan of
design which hearing was continued to February 20,
1990. At the hearing on February 20, 1990, the
Council received evidence from the staff and heard
from the applicants and members of the public. The
Council has carefully considered all of the
evidence and public comments received at the
hearing.
SECTION 2. Having considered all of the oral and
written evidence presented to it at said public hearings,
the City Council further finds, determines and declares
that:
A. The subject property is a rectangular parcel
located at the northwest corner of Irwindale Avenue
and Roosevelt Street. The parcel is 88 feet wide
and 90 feet deep and is developed with a commercial
building located along the front property line.

B. The Casablanca Bar is currently operating in
the northern most portion of the building. Section
19.34.030[68] of the Azusa Municipal Code requires
that existing bars in the M2 zone obtain a
conditional use permit to continue their
operations.
C. The property is maintained in fair to poor
condition. The front of the building is well
maintained and some landscaping is provided along
Irwindale Avenue. The right-of-way along Roosevelt
Street is barren. The projecting roof sign
identifying the bar is no longer permitted under
the City's sign ordinance. The rear of the
building is utilized for a variety of unpermitted
outdoor storage purposes and little parking is
available. No trash enclosure is provided on the
property.
D. Some improvement should be made to this
property in order to improve the overall quality of
the site. The rear door to the bar, which is
remaining from its previous use as an industrial
business, should be replaced with an appropriate
commercial door. The projecting roof sign should
be removed and replaced with an appropriate wall or
free-standing sign in conformance with the
requirements of the Azusa Municipal Code.
Landscaping should be provided within all unpaved
areas of the public right-of-way. A trash
enclosure should be provided at the rear of the
building and an outdoor storage area should be
appropriately screened.
E. Space for parking is limited both on this site
and in particular the surrounding industrial area
in general. Subject bar should provide at least
four offstreet parking spaces for its customers.
However, the rear of the building has only a small
open area directly behind the bar which can be
utilized for parking. Further, this situation is
also found on most nearby properties, effectively
eliminating the possibility of finding additional
parking elsewhere. The open area behind the bar
should be striped to at least clearly identify the
parking spaces which are available on the site.
F. The Azusa Police Department reports that this
bar has generally been operated in a responsible
and businesslike manner. There have not been an
inordinate number of complaints or police calls
generated by this business. If this record is
maintained, this bar should be able to continue as
a functional component of its surrounding
industrial area.
G. The operations of this bar have historically
not been objectionable or disruptive to the
surrounding industrial area. If the aforementioned
physical improvements are made to the property, the
building and its premises will be compatible with
the standards for existing commerical businesses
within this industrial area. The responsible

operation of this business in an

H. Accordingly, the conditional use permit and
the precise plan of design would not adversely
affect the public peace, health, safety or general
welfare and that the public necessity, convenience,
welfare and good zoning practice justifies the
issuance of the conditional use permit and the
precise plan of design.
I. This project has been found to be
categorically exempt from the California
Environmental Quality Act as a Class 1(a)
categorical exemption pursuant to the City of Azusa
CEQA Implementing Procedures and the State CEQA
Guidelines.
SECTION 3. Based upon the findings set forth in
Sections 1 and 2 of this Resolution, the City Council of the
City of Azusa hereby approves conditional use permit No.
C-89-21 subject to the conditions of approval attached
hereto as Exhibit A and also approves precise plan of design
No. P-89-204 also subject to the conditions of approval
attached hereto as Exhibit A.
SECTION Q. The City Clerk shall certify the
adoption of this Resolution.

I HEREBY CERTIFY that the foregoing Resolution was

REVIEW OF EXISTING BAR
All requirements of the Planning Division shall be met,
including but not limited to the following:
a. The approval hereby granted is conditional upon the
privileges being utilized within six (6) months after
the effective date thereof and if they are not utilized
or construction work is not begun within said time and
carried on diligently in acordance with conditions
imposed, this approval shall become void and any
permission or privilege granted hereby shall be deemed
to have elapsed.
b. All necessary permits shall be obtained.
C. All applicable Building Department and Fire Department
requirements shall be met at all times.
d. Entire rear of property shall be developed as a parking
area in conformance with Chapter 19.48 of the Azusa
Municipal Code, including landscaping, parking stalls,
and other improvements. A parking plan shall be
submitted to the Planning Division for approval.
e. Parking shall be striped and shall have adequate guards
for protection of other vehicles on same lot (i.e. wheel
stops).
f. Landscaping shall be adequately maintained at all times
including, but not limited to, irrigation, weeding,
and/or replacement when necessary.
g. Trash enclosuress shall be provided and constructed to
City of Azusa standards, consisting of decorative
masonry block walls and solid steel gates.
h. The premises shall be maintained in a clean and
acceptable condition at all times. All buildings and
walls shall be maintained in good repair at all times.
Any offensive markings shall be removed immediately.
i. Outside storage of any and all materials, equipment,
etc., within required parking areas is prohibited.
j. All signs must comply with those sign regulations set
forth in Section 19.50 of the Azusa Municipal Code to
include restrictuions on sign area, sign types, sign
materials, and sign height. Existing Projecting sign
shall be removed.
k. Portable signs on the property are prohibited.
1. Temporary signs on the property shall meet all
requirements of Section 19.50.150 of the Azusa
Municipal Code.
M. All roof equipment shall be screened to the satisfaction
of the planning staff.
n. Rear door shall be replaced with a standard commercial
door.
o. Should,. for any reason, the Alcoholic Beverage Control
license for this establishment be revoked, the
conditional use permit shall be scheduled before the
Planning Commission for revocation.
p. Subject conditional use permit (C-89-21) shall be
reviewed by the Community Improvement Division every
three (3) years.
2. All requirements of the Public Works Department shall be met,
including but not limited to the following:
a. A landscaping and irrigation plan shall be submitted at
the same time as Building plan check submittal, showing
locations, quantities, sizes, and types of plant
materials, as well as design of an automated irrigation
system. Plans shall be 24" by 36".
b. Right-of-way along Roosevelt Street shall be landscaped
to the satisfaction of the Public Works Division.
