RESOLUTION NO. 8892
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA INITIATING PROCEEDINGS FOR ANNUAL
CONFIRMATION OF THE LEVY AND COLLECTION OF
ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING
AND LIGHTING ASSESSMENT DISTRICT FOR FISCAL
YEAR 1990-91
On Julv 16 , 1990 on motion of Council -
member Naranio duly seconded by Councilmember
Dan g11 and carried, the City Council of
the City of Azusa (the "Council") RESOLVES AS FOLLOWS:
Section 1. The Council finds and determines:
(A) That the Council in 1989 formed its Landscaping
and Lighting Assessment District No. 1 (the "Assessment
District") and in 1989-90 levied an assessment collected on the
utility bills for subscribers within the boundaries of that
Assessment District pursuant to the provisions of the Landscaping
and Lighting Assessment District Act of 1972, Streets and
Highways Code Sections 22500 et.seq., such assessment to be known
as the "community maintenance fee"; and
(B) That the following improvements have been
installed, constructed, maintained, administered and serviced
within such Assessment District:
City parks, medians and other landscaping along
City streets with the Assessment District as well
as associated curb, gutters, drains and streets.
(C) That the Assessment District has the same
boundaries as the City, as more fully described in Exhibit "A",
attached and incorporated by this reference; and
(D) That the Assessment District is known as the City
of Azusa Landscaping and Lighting Assessment District No. 1; and
(E) That the Board has requested that the City
Engineer prepare the annual engineer's report and budget as
described in Street and Highways Code Annual Sections 22565-
22574, providing for assessment and collection based on the
utility users;
Section 2. Now, therefore, the Council resolves and
orders:
and (A) That the above recitals are all true and correct;
(B) That the City Engineer shall prepare and file with
the Council a report and budget as set out herein and in
accordance with Streets and Highways Code Sections 22556-22574
for the confirmation of an annual assessment within the
Assessment District for such installation, construction,
maintenance, administration and service for Fiscal Year 1990-91,
to be collected on the utility bill.
Section 3. The City Clerk shall certify to the
adoption of this Resolution and thenceforth and thereafter the
same shall be in full force and effect.
