HomeMy WebLinkAboutResolution No. 8955RESOLUTION NO. 8955 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING PRECISE PLAN OF DESIGN NO. P-89-132, THOMAS HALE/99 CENT STORE FOR THE PROPERTY LOCATED AT 730 W. 'FOOTHILL BOULEVARD THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE'AS'FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: Y A. An application was filed by 99 Cent Store/Thomas Hale for a precise plan of design for an existing retail store located at 730 W. Foothill Boulevard, Azusa ("subject property"). B. On September 12, 1990, the Planning Commission approved Precise Plan of Design No. P-89-132 subject to certain conditions. C. On October 1, 1990, Thomas Hale, Vice President and Corporate officer of the 99 Cent Stores, appealed the Planning Commission's decision to the City Council. : D. On October 15, 1990, the City Council held a duly noticed public hearing on the Precise Plan of Design and has carefully considered all of the evidence and public comments received at said hearing. E. At the public hearing Mr. Hale, on behalf of the Applicant, advised the Council that all of the conditions of approval attached to the Planning Commission Approval were acceptable except for "Condition No. 1.r. Mr. Hale further advised the Council that while the Applicant objected to a masonry block wall, they would accept a condition permitting the existing chain link fence to remain with redwood slats inserted in the chain links. F. .Approval of Precise Plan of Design No. P-89-132 would not substantially depreciate ' .property values in the vicinity and would not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants.thereof for lawful purposes and would not adversely affect the public peace, health, safety or general -welfare. G. Precise Plan of Design No. P-89-132 is approved by this Resolution and is consistent with the General Plan of the City of Azusa and each of the elements thereof. SECTION 2. Based on the findings set forth in Section l of this Resolution, the City Council of the City of Azusa hereby approves Precise Plan of Design No. -1- pmt/RES28344 10/31/90 Exhibit "Ali " P-89-132 730 W. Foothill Blvd. Design Review 1. All requirements of, the Planning Division shall be met, including but not limited to the following: a. 'All uses 7 shall comply with Section 19.34 of the Azusa Municipal Code. b. The approval hereby granted is conditional upon the privileges being utilized within six (6); months after the effective date thereof and if they are not utilized' or construction work 10 not begun within said time and carried on diligently in acordance with conditions imposed, this approval shall become- void and any permission Or privilege granted hereby .shall be deemed to have elapsed. C. All necessary, permits shall be:obtained. d. All construction shall comply with the plot plan submitted. e. All portions of lot, with the exception .of driveway areae and building locations shown on plans submitted, shall be completely -.and adequately landscaped at all times. f. Parking of vehicles on areas other than paved surfaces or in garages is prohibited. _ h. ,Landscaping shall be adequately maintained at all times including, but not limited to, irrigation, weeding, and/or replacement when necessary. i. The premises shall be maintained in a clean and acceptable- condition at all times. All buildings and walls shall. be maintained in good repair at all times. Any offensive markings shall be removed immediately., j. Outside storage of any and all materials, goods, etc., is absolutely prohibited. k. All applicable Building Department and Fire Department requirements shall be met at all times. 1. Nineteen (19) parking spaces shall be provided -and . maintained in accordance with Chapter 19.48 of the Azusa Municipal Codec M. One (1) loading space shall be provided and maintained in size of not less than 101 in width, 22' in length, and 14' in height. n. Parking shall -be striped and shall have adequate guards for.protection of other vehicles on same lot (i.e. wheel stops). o. Three (31) perimeter landscaping shall be provided along perimeter of parking area, except for areas adjacent to buildings. p. Trash enclosures shall be provided and constructed to City of Azusa .standards, consisting of decorative splitface ..or slumpstone masonry block walls and solid steel gates. q. Applicant shall provide and maintain a litter recepticle outside of the business and be responsible for keeping the..recepticel and the area around it clean and free of excess trash or debris at all times. r. Street "trees shall be provided at a maximum spacing of 35 feet. . Trees shall include sidewalk grates from root protection. W. All existing planters shall be reparied and replanted to the satisfaction of the. Public Works Department. Planters shall be expanded where possible to utilize concrete curbing at boundaries to replace wheel •stops for adjacent parking stalls. X. All barbed wire shall be removed from the property. y. outdoor storage areas shall be removed. Protective fencing around boiler shall be replaced with 'decorative block- walls to match other required. walls on the property. Area around boiler and trash enclosure location shall be minimized to allow for additional on- site parking area. All requirements of., the Building Division shall be met,, including but not limited to the following: a. All "appropriate development fees Of the Azusa Unified . School District shall be paidin full prior to issuance of any building permit for the approved construction. - b. Applicant recognizes that approval granted is for planning and zoning only. owner is obligated to meet all Building -.'Code ,requirements, and is obligated to do whatever necessary to bring the structure in compliance. with applicable,City-adopted Uniform codes. That all conditions of the Public Works Division shall be met, including but not limited to the following: a. Three (3) parkway trees are required, located ho closer than 30 ft. nor greater than 65 ft. apart and shall be irrigated per City Plan R-15.' Variety to be specified by Superintendent and shall be at least 15 gallon size. b. No work within the public right of way shall be, commenced without first obtaining a public works permit. C. A landscaping and irrigation plan shall be submitted at the same time as Building plan check submittal,,showing locations, quantities, sizes, and types of plant materials, as well as design of an automatedirrigation system. Plans shall be 24" by 3611. d." A maintenance agreement shall be executed between the city and the property owner, binding the property owner to 'maintain the landscaping improvements'. within the public right of way. This agreement shall be recorded. P-89-132, subject to the conditions of approval attached , hereto as Exhibit "A", with the exception of Condition_ No. i.r.,, Condition No. i.r. on Exhibit "A" shall be replaced with the following condition: "i.r. The chain link fence on the southern property line shall be maintained and redwood slats shall.be added to'the chain links on this fence. The redwood slats shall be maintained in a neat and clean condition and shall be replaced when broken." SECTION. The City Clerk shall certify the adoption of this Resolution.
