HomeMy WebLinkAboutResolution No. 91-C048RESOLUTION NO. 91-C48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING THE APPEAL OF APPLICANT GEORGE YEH/ECONOLODGE AND DENYING PRECISE PLAN OF DESIGN NO. P-90-267 THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. George Yeh/Econolodge ("Applicant") have appealed the denial of Precise Plan of Design No. P-90-267 ("Precise Plan of Design") by the Planning Commission for the proposed construction of a 31 unit motel on property located at 444 East Foothill Boulevard ("Site"). Precise Plan of Design No. P-90-267 was denied by Resolution No. 91-15 of the Planning Commission on February 13, 1991. B. On April 1, 1991, the Council held a duly noticed public hearing on the appeal and application for the Precise Plan of Design which was continued, at the request of the Applicant, to April 15, 1991 and continued again, by the Council to May 6, 1991. C. The Council has carefully considered the Planning"Commissionts determination, the staff reports submitted in connection with this appeal and application, and the written and oral public comments received at said hearings. D. Currently there exist several motels located within the City which have encountered particularly low occupancy rates. The lack of demand for conventional motel rooms for short term occupancies has caused several motels to accept long term occupancies, and in effect, the motels have been converted into apartment buildings, contrary to the zoning classification and development standards required under Title 19 of the Azusa Municipal Code and the building regulations contained in the State Housing Law and the Azusa Municipal Code. These sites are not zoned for residential uses, and these units do not have many of the amenities associated with most apartment complexes. E. Evidence has also been received concerning the financial feasibility of a motel on this Site. Occupancy levels for other motels in Azusa have been lower than those within the San Gabriel Valley, which, in turn, have recently been lower than those in Los Angeles County as a whole. Applicant has not shown a demonstrated need for an additional motel where given the evidence that existing motels have had high vacancy rates for extended periods. The poor market for motel space in Azusa means it is likely the proposed motel will 0 0 suffer the same land use problems as the other motels. F. The Precise Plan of Design indicates that a proposed motel would be located in the C2 zone, Restricted Commercial Zone. A C2 zone does not include residential apartment uses and, yet, given the facts set forth herein concerning the feasibility of the motel use proposed for this Site, it is likely that the motel would not support sufficient short term occupancies to prevent its use as a motel for long term occupancies and conversion to substandard residential apartments contrary to the zoning regulations. G. The Council recognizes that zoning in general, is not intended to regulate the economic marketplace and that decisions on applications for new businesses should not be based solely on the financial effect which an application would have on similar land uses. However, if the potential exists for a land use problem to occur due to the unlikelihood of a business to succeed, then these economic forces are legitimate zoning concerns. The poor market for motel space in the Azusa area has already resulted in the defacto conversion of several motels into apartment buildings. There are no mitigation measures which could be imposed on this project which would, with any degree of certainty, eliminate the possibility of an incompatible land use. H. Approval of Precise Plan of Design No. P-90-267, therefore would substantially depreciate property values in the vicinity, unreasonably interfere with the use or enjoyment of property in the vicinity by occupants thereof for lawful purposes and would adversely affect the public peace, health, safety and general welfare to a degree greater than that generally permitted by the Azusa Municipal Code. SECTION 2. Based on the findings set forth in Section 1 of this Resolution, the City Council of the City of Azusa hereby denies the appeal of Applicant and denies Precise Plan of Design No. P-90-267. SECTION 3 The City Clerk shall certify the adoption of this Resolution.
