HomeMy WebLinkAboutResolution No. 91-C037NO. 91-C37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING PRECISE PLAN OF DESIGN NO. P-90-257 AND DENYING THE APPEAL OF THE SAME BY THE APPLICANT, REYNOLDS ALUMINUM THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION .1. The City Council of the City of Azusa does hereby find, determine and declare that: A. Reynolds Aluminum (or "Applicant") operates a trailer for the recycling of aluminum materials at the Azusa Ranch Market located at 150 West Ninth Street. The trailer is positioned on the Azusa Ranch Market property at a location near to and facing Ninth Street, near residential development; B. , Reynolds Aluminum duly filed an application for a precise plan of design ("P-90-25711) with the City of Azusa for the establishment of said trailer. On or about January 2, 1991, the Planning Division approved P-90-257, subject to conditions. Upon notice to the Applicant, on or about February 13, 1991, the Planning Commission conducted a hearing and denied an appeal of P-90-257 filed by the Applicant. The Applicant then appealed P-90- 257 to the City Council. Upon notice duly given, the City Council held a hearing on April 1, 1991 in which the Applicant was present and was afforded the opportunity to contribute; C. At the April 1, 1991 City Council hearing, evidence was presented, including without limitation the findings of the Planning Division and various staff reports, and testimony was presented by the Applicant and various City officials. Based upon said evidence and testimony, the City Council made the following findings: (1) The current location of the trailer has resulted in numerous complaints from nearby residents regarding the appearance of the trailer, the litter and noise generated by its placement at its current location, and its physical condition of disrepair; (2) The establishment of the trailer at its present location is incompatible with the residential area surrounding the Azusa Ranch Market because of these problems; (3) The Planning Divisionts Condition of Approval No. 1(c) of P-90-257, requiring that the trailer be relocated to the rear of the Azusa Ranch Market property and that its final location is subject to Planning Division approval, is a reasonable condition which is 0 • connected to the general welfare, health, and safety of the residents of the City of Azusa. (4) The City Council has considered its important role in the siting of recycling centers in conjunction with the State of California's efforts to control beverage container litter and to promote beverage container recycling in convenience zones. The City Council finds that the approval of the Precise Plan of Design No. P-90-257 subject to the conditions adopted by the Planning Division should not have any adverse effect on recycling efforts. SECTION _Z. The City Council of the City of Azusa hereby denies the appeal of Reynolds Aluminum and approves Precise Plan of Design No. P-90-257 subject to the conditions set forth on Exhibit A attached hereto. SECTION 3. Approval of Precise Plan of Design No. P-90-257 is exempt from the provisions of the California Environmental Quality Act pursuant to 14 California Code of Regulations Sections 15304, 15305 and 15311. SECTION 4. The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 15th day of April , 19S1_. All requirements of the Planning Division shall be met, including but not limited to the following: a. The approval hereby granted is conditional upon the privileges being utilized within six (6) months after the effective date thereof and if they are not utilized or construction work is not begun within said time and carried on diligently in accordance with conditions imposed, this approval shall become void and any permission or privilege granted hereby shall be deemed to have elapsed. b. All .applicable Building Department and Fire Department requirements shall be met at all times. C. Trailer shall be relocated immediately from its present location adjacent to Ninth Street to the rear of property. Applicant shall submit a revised plot plan showing this location. Final location is subject to Planning Division approval. d. The premises shall be maintained in a clean and acceptable condition at all times. Litter and debris shall be removed as necessary. 2. All requirements of the Building Division shall be met, including but not limited to the following: a. Applicant recognizes that approval granted is for planning and zoning only and the owner is obligated to meet all applicable Building Division requirements. b. Applicant shall provide one (1) handicapped parking space located as close as possible to front of trailer. PAGE 1 OF 1
