A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AZUSA DENYING AN AMENDMENT TO
PRECISE PLAN OF DESIGN NO. P-90-257
RELATING TO THE PLACEMENT OF A TRAILER
FOR RECYCLING PURPOSES LOCATED ON
PROPERTY AT 150 WEST NINTH STREET
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Azusa
does hereby find, determine and declare that:
A. On April 1, 1991, the City Council denied an
appeal of Precise Plan of Design No. P-90-257 which
restricted the location of a Reynolds aluminum
recycling trailer to the rear of the property
occupied by the Azusa Ranch Market at 150 West
Ninth Street (the "Property"). Subsequently,
Reynolds removed the trailer from the property
altogether.
B. Another recycling business, Beverage Container
Recycling ("Applicant"), applied to the Azusa
Planning Commission for an amendment to Precise
Plan of Design No. P-90-257 to locate recycling
bins and a trailer at the northeast corner of the
property as opposed to the rear portion.
C. On July 10, 1991, the Planning Commission
approved the amendment to Precise Plan of Design
No. P-90-257. On July 15, 1991, the City Council
of the City of Azusa appealed the July 10, 1991
Planning Commission decision. Upon notice duly
given, the City Council held a hearing on August 5,
1991 in which the applicant was present and was
afforded the opportunity to contribute.
D. At the August 5, 1991 City Council hearing,
evidence was presented, including without
limitation the findings of the Planning Commission,
staff reports and diagrams of the proposed location
of the recycling facility on the property, and oral
public testimony was presented. Based upon said
evidence and testimony, the City Council made the
following findings:
(1) The establishment of the recycling
trailer and the two recycling storage bins at
its proposed location is incompatible with the
residential and commercial area surrounding
the Azusa Ranch Market because the size, bulk,
and appearance of these objects raise
aesthetic, litter, noise and traffic concerns;
(2) The City Council's April 1, 1991 approval
of Precise Plan of Design No. P-90-257
requiring that recycling facilities be located
to the rear of the Azusa Ranch Market property
is a reasonable condition which is connected
to the general welfare, health and safety of
the residents of the City of Azusa;
(3) The City Council has considered Azusa's
role in deciding recycling centers in
conjunction with the State of CaliforniaFs
efforts to control beverage container litter
and to promote beverage container recycling in
convenient zones. The City Council finds that
alternative recycling options, such as the
placement of recycling facilities towards the
rear of the Azusa Ranch Market property and/or
the placement of recycling vending machines,
are available to the Applicant. The City
Council further finds that the granting of the
appeal and the denial of the amendment to
Precise Plan of Design No. P-90-257 should not
have any adverse effect on recycling efforts.
SECTION 2,. The City Council of the City of Azusa
hereby grants the appeal of the Amendment to Precise Plan of
Design No. P-90-257 and overturns the July 10, 1991 decision
by the Planning Commission approving said amendment.
Thereby, the City Council denies the amendment to Precise
Plan of Design No. P-90-257.
SECTION 1. The City Clerk shall certify the
adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 19th day of
August , 1991.
