HomeMy WebLinkAboutResolution No. 91-C176RESOLUTION NO. 91_176 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE NEGATIVE DECLARATION FOR AMENDMENT NO. 180 TO THE AZUSA MUNICIPAL CODE PERTAINING TO REGULATION OF SECURI- TY BARS IN COMMERCIAL AND INDUSTRI- AL AREAS L THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1: The City Council of the City of Azusa hereby finds: A. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for Amendment No. 180 to the Azusa Municipal Code (hereinafter "Project") in accordance with the provisions of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines; B. Duly noticed public hearings were held by the Planning Commission for the City of Azusa on September 25, 1991 and by the City Council of the City of Azusa on November 4, 1991 at which times evidence was heard on the proposed Project and the Negative Declaration; C. Prior to approving the Project, the City Council of the City of Azusa considered the Initial Study of Environmental Impact and the Negative Declaration together with any comments received during the public review process; D. The City Council of the City of Azusa hereby finds and determines that on the basis of the Initial study and any com- ments received in the public review process, there is no substan- tial evidence that the Project will have a significant adverse effect upon the environment; E. The City Council of the City of Azusa further finds and determines that, as a result of the Initial Study and any com- ments received during the public review process, the Project will not result in any adverse effect, either individually or cumula- tively, on wildlife (as defined by Section 711.2 of the Fish and Game Code) or on wildlife habitats and resources. SECTION 2: The Negative Declaration for the Project, attached hereto as exhibit "A" and by this reference incorporated herein, is hereby certified and approved and shall be filed with the County Clerk of the County of Los Angeles. SECTION 3: The Director of community Development shall sign and file two copies of a Certificate of Fee Exemption (DFG 753.5 - 1/81) with the County Clerk of the County of Los Angeles. DISCUSSION OF ENVIRONMENTAL EVALUATION 8.b. Project would amend existing zoning requirements to require that all secruity bars, gates and doors be placed on the inside of doors, windows and storefronts. 18. SUMMARY The City Council has expressed concern about the installation of security gates on the outside of commercial buildings. This portrays a negative image to the City. The attached code amendment would require any installation of such security devices in commercial and industrial areas to be on the inside of the building. Such installations would have to meet all other applicable codes, including exiting requirements. Security gates and bars legally existing prior to the adoption of this ordinance would be allowed to remain as nonconforming structures. If the City Council agrees that this is appropriate for the City, Staff will proceed with its adoption. RECOMMENDED ACTION The City Council should either: 1. Direct the Planning Commission to commence adoption of the attached ordinance requiring security gates and bars in commercial areas to be installed indoors, W 2. Take action as deemed appropriate. W tr 1 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, ADOPTING CODE AMENDMENT CASE NO. AMENDING CHAPTER 19.40 OF THE AZUSA MUNICIPAL CODE ENTITLED GENERAL PROVISIONS AND ADDING A SECTION ENTITLED SECURITY GATES AND BARS THE CITY COUNCIL OF THE CITY OF AZUSA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 19.40.200 is hereby added to Chapter 19.40 of the Azusa Municipal Code as follows: "19.40.200 SECURITY BARS. In commercial buildings or buildings used for commercial purposes, all security bars covering windows, and security gates covering door openings or storefronts, shall be installed on the inside of said window, door opening or storefront. The installation and maintenance of such security devices shall be in accordance with all applicable codes." SECTION 2: The City Clerk shall certify as to the adoption of this ordinance.
