LEE AND CAROL SAWYER AND DENYING THE GENERAL PLAN AMENDMENT NO. GPA -91-2, ZONE CHANGE NO. Z-91-1, CONDITIONAL USE PERMIT NO. C-91-10, VARIANCE NO. V-91-4 AND PRECISE PLAN OF DESIGN NO. P-91-119 PERTAINING TO THE CONSTRUCTION OF A 23 -UNIT DETACHED CONDOMINIUM PROJECT THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare that: A. Kam P. Lee and Carol Sawyer ("Applicants") have duly appealed the denial by the Planning Commission of their applications for General Plan Amendment No. GPA -91-2, Zone Change No. Z-91-1, Conditional Use Permit No. C-91-10, Variance No. V-91-4 and Precise Plan of Design No. P-91-119 (collectively "applications"), all for the proposed construction of 23 detached condominiums (the "condominium project") on property located at 1750 Azusa and San Gabriel Canyon Road (the "site"). On September 11, 1991, the Planning Commission denied the foregoing applications by Resolution Nos. 91-65, 91-64, 91-66, 91-67 and 91-68, respectively. B. On October 21, 1991, the City Council held a duly noticed public hearing on the appeal and the applications. The City Council has carefully considered the Planning Commission's determination, the Staff Reports submitted in connection with the applications and this appeal, the Notice of Appeal submitted by the Applicants on September 26, 1991 and the written letters and comments and oral testimony of the public received at said hearing. C. The existing permitted use of the site is rural residential, designated "R" under the General Plan and zoned "RA" under the Azusa Municipal Code. The site consists of a single house and horse stables. The existing use is consistent with the uses on the eastern side of Azusa and San Gabriel Canyon Road adjacent to the Site, although a higher density condominium use exists on the western side of Azusa and San Gabriel Canyon Road. D. The applicants request a zone change from "RA" to "R3a" (Multi -Family Residential), an amendment to the Land Use Element of the Azusa General Plan from "R" to "M" (Medium Density Residential) a conditional use permit and precise plan of design for a detached condominium project and a variance for reduced rear yard setback requirements for future patios within the condominium project. E. The requested general plan amendment to medium density residential and the requested zone change to multi -family residential is inconsistent with the current rural residential uses along the eastern side of Azusa and San Gabriel Canyon Road extending to the foothills of the San Gabriel Mountain Range. There is a need to preserve the rural and lower density uses in this area. An increase in density to the level proposed would cause additional land development, traffic and noise which would compromise the long-term objective of the Azusa General Plan to preserve a rural, low density use compatible with the adjacent foothills to the San Gabriel Mountain Range. F. The variance and conditional use permit requested by applicants are inconsistent with the current general plan land use designation "R" and the "RA" zoning under the Azusa Municipal Code. G. Approval of Precise Plan of Design No. P-91-119 therefore would substantially depreciate property values in the vicinity of the Site, unreasonably interfere with ti,.e lawful use or enjoyment of property in the vicinity by each respective occupant and would adversely affect the public peace, health, safety and general welfare to a degree greater than that generally permitted by the Azusa Municipal Code. SECTION 2. Based on the findings set forth in Section 1 of this Resolution, the City Council of the City of Azusa hereby denies the appeal of Applicants and denies General Plan Amendment No. GPA -91-2, Zone Change No. Z-91-11 Conditional Use Permit No. C-91-10, Variance No. V-91-4 and Precise Plan of Design No. P-91-119. SECTION 3. The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 4th. day of November 1991.
