HomeMy WebLinkAboutResolution No. 91-C178sECTION 1'.(B).ANENDED.BY RESOLUTION 92-C120 RESOLUTION NO. 2L&_U8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REVISING CERTAIN REPORTS CONCERNING THE LEVY AND COLLECTION OF THE FIRE SUPPRESSION BENEFIT ASSESSMENTS AND THE CITY OF AZUSA LANDSCAPING AND LIGHTING DISTRICT NO. 1 ASSESSMENTS (COMMUNITY MAINTENANCE FEES) AND REDUCING THE AMOUNTS OF THE ASSESSMENTS THEREOF THE CITY COUNCIL OF THE CITY OF AZUSA does hereby resolve as follows: SECTION 1. That the City Council of the City of Azusa (the "City Council") does hereby find, determine and declare as follows: (A) The City Council by ordinance adopted and levied assessments pursuant to Sections 50078 et seq of the California Government Code (the 'Benefit Assessment Act"), collected such assessments on the utility roll to finance fire suppression services within the City (the "Fire Suppression Benefit Assessments") and approved a report related thereto (the "Fire Suppression Benefit Assessment Report"); and (B) The City Council by resolution formed the City of Azusa Landscaping and Lighting District No. 1 (the "District"), levied and collected on the utility roll (Community Maintenance Fees) assessments, collected such assessments on the utility roll to finance improvements within the District and approved an Engineer's Report (the "Landscaping and Lighting Assessment Report") pursuant to the Landscaping and Lighting Act of 1972 (Sections 22500 et seq of the California Streets and Highways Code)(the "Landscaping and Lighting Act"); and (C) The City Council by motion has requested that the Fire Suppression Benefit Assessment Report and the Landscaping and Lighting Assessment Report be modified to reduce the assessments contained therein; and (D) Contributions through available funds of the City have been or will be provided which allows the City to reduce certain assessments, and such available funds and reduced assessments will be sufficient to provide the improvements and services referenced in the Fire Suppression Benefit Assessment Report and the Landscaping and Lighting Assessment Report; and (E) The City Council has duly noticed public hearings on the issues of approving the revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report which reports each propose to reduce the rates of all of their respective assessments to $0 for the period commencing December 1, 1991; and (F) At the time and place noticed, the City Council duly conducted a combined public hearing and considered any and all protests against the reduction of such assessments and the approval of the revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report; and (G) No majority protests existed. SECTION 2. That it is hereby ordered by the City of Azusa as follows: (A) The revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report on file with the City Clerk is hereby approved, confirmed and adopted and a copy of this Resolution and such reports shall remain on file with the City Clerk and available for public inspection; and (B) All assessments set out in the revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report for the period commencing December 1, 1991 shall be reduced to $0 and are hereby confirmed; and (C) Contributions through available funds of the City have been or will be provided which allows the City to reduce certain assessments to $0, and such available funds and other collected assessments shall be sufficient to provide the improvements and service referenced in the revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report; and (D) Except as referenced in this Resolution and the revised Fire Suppression Benefit Assessment Report and the revised Landscaping and Lighting Assessment Report on file with the City Clerk, such reports and authorizing ordinances and resolutions shall remain in full force and effect; and (E) Resolution 1191-C158 is hereby rescinded. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 2nd day of DECEMBER, 1991.
