HomeMy WebLinkAboutResolution No. 91-C1770 RESOLUTION NO. 91-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CONDITIONAL USE PERMIT C-415 EXTENDING THE TIME FOR THE RESIDENTIAL USE OF PROPERTY LOCATED AT 324-350 WEST FOOTHILL BOULEVARD THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare as follows: A. On December 1, 1986, the City Council adopted Resolution No. 8147 which approved Conditional Use Permit C-415 (the "C.U.P.") for the expansion of a non -conforming automobile sales use on property owned by Frederick and Joan Petersen (the "property owners") and located at 324-350 West Foothill Boulevard (the "subject property"); B. The C.U.P., at Condition A of Section 2 of Resolution 8147, requires the property owners to terminate certain non -conforming residential uses on the subject property on or before November 17, 1991; C. On September 23, 1991, the property owners made a written request for a five year extension of Condition A. On October 16, 1991, the Planning Commission held a duly noticed public hearing and recommended to the City Council that the C.U.P. be amended to allow the five year extension to Condition A; D. On November 18, 1991, a duly noticed public hearing was conducted by the City Council who considered amending the C.U.P., at Condition A, to allow the property owners a five year extension to terminate the non -conforming residential uses on the subject property; E. The City Council determined that extending the time for termination of the non -conforming residential uses on the subject property by five years would not adversely impact public safety, health and welfare of persons in the central business district zone surrounding the subject property and other persons in the surrounding areas; and F. In taking this action, the City Council has considered the environmental impact of its decision, and afer careful study, has determined that this project is categorically exempt as a Class 1(1) project under the provisions of the California Environmental Quality Act, the California Environmental Quality Act Guidelines (Title 14 C.C.R. $ 15301) and the City of Azusa's • environmental procedures. therefore, finds that this significant effect on the 0 The City Council, project will have no environment. SECTION 2. Based on the October 16, 1991 Planning Commission recommendation, Resolution No. 8147, staff reports, and public comments received and considered at the City Council meeting of November 18, 1991, Condition A of Section 2 contained in Resolution No. 8147 is hereby amended in full to read as follows: "A. Property owners shall terminate the non- conforming residential uses on the properties on or before November 17, 1996, and will convert the residential structures to permitted commercial structures with all required city approvals on or before November 17, 1997, or demolish." SECTION 3. All other conditions and provisions of Resolution No. 8147 shall continue to be in full force and effect, except as explicitly modified by this Resolution. SECTION 4.
