HomeMy WebLinkAboutResolution No. 92-C012RESOLUTION NO. 92-C12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE NEGATIVE DECLARATION FOR CODE AMENDMENT 177 TO THE AZUSA MUNICIPAL CODE PERTAINING TO RESTRICTIONS ON GUEST HOUSES AND OVERSIZED RESIDENCES THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa hereby finds: A. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for Code Amendment No. 177 to the Azusa Municipal Code pertaining to restrictions on guest houses and oversized residences (hereinafter "Project") in accordance with the provisions of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines; B. Duly noticed public hearings were held by the Planning Commission for the City of Azusa on September 11, 1991 and November 13, 1991 and by the City Council of the City of Azusa on October 7, 1991 and December 16, 1991 at which times evidence was heard on the proposed Project and the Negative Declaration; C. Prior to approving the Project, the City Council of the City of Azusa considered the Initial Study of Environmental Impact and the Negative Declaration together with any comments received during the public review process; D. The City Council of the City of Azusa hereby finds and determines that on the basis of the Initial Study and any com- ments received in the public review process, there is no substan- tial evidence that the Project will have a significant adverse effect upon the environment; E. The City Council of the City of Azusa further finds and determines that, as a result of the Initial Study and any com- ments received during the public review process, the Project involves no potential for adverse effect, either individually or cumulatively, on wildlife (as defined by Section 711.2 of the Fish and Game Code) or on wildlife resources. SECTION 2. The Negative Declaration for the Project, at- tached hereto as Exhibit "A" and by this reference incorporated herein, is hereby certified and approved and shall be filed with the County Clerk of the County of Los Angeles. SECTION 3. The Director of Community Development shall sign ad file two copies of a Certificate of Fee Exemption (DFG 753.5 - 1/81) with the County Clerk of the County of Los Angeles. 2462 1 The City Clerk shall certify to the adoption of this Resolu- tion. DISCUSSION OF ENVIRONMENTAL EVALUATION 8.b. Project will involve amending the Azusa Municipal Code to prohibit guest houses and to limit oversized residences 12. Project would prohibit future construction of guest houses and residences with floor area ratios which are out of scale with surrounding densities. Existing structures will not be affected except for possible application of non- conforming structure ordinances. IV. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None required. DETERMINATION (To be completed by Lead Agency) On the basis of this initial evaluation: X I find the proposed project COULD NOT HAVE a significant effect on the-environmefit, and a NEGATIVE DECARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
