HomeMy WebLinkAboutResolution No. 92-C0620 RESOLUTION N0.92=962 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA GRANTING AN APPEAL OF A DENIAL BY THE PLANNING COMMISSION OF AN APPLICATION FOR VARIANCE NO. V-92-3 AND PRECISE PLAN OF DESIGN NO. P-92-17 REGARDING PROPERTY LOCATED AT 916 EAST NEARFIELD STREET THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare as follows: A. After a public hearing duly noticed, the Planning Commission on March 11, 1992 adopted Resolutions Nos. 92-29 and 92-30 denying Variance No. V-92-3 and Precise Plan of Design No. P-92-17 respectively. Said decisions were made after a full review of the applicant's application, the staff report, and testimony given at the public hearings. True and correct copies of Resolution Nos. 92-30 and 92-29 are attached hereto and incorporated herein by this reference; B. Thereafter, the property owner filed a timely appeal to the City Council; C. On April 6, 1992, after proper notice being duly given, a public hearing was held before the City Council of the City of Azusa on the property owner's appeal of the Planning Commissions' denial of Variance No. V-92-3 and Precise Plan of Design No. P-92-17; D. In their written application for an appeal, the property owners did not dispute the fact that a two -car garage has been used for living space without any of the required permits or variances. The property owner represented that he had paid taxes on the additional liveable square footage in the residence and that he would suffer hardship from a requirement that the illegally converted space be converted back to a garage; E. After a review of the application for appeal, the record of the Planning Commission proceedings, the staff report, and the comments of the property owner and others appearing at the public hearing, the City Council determined that the necessary findings could be made to grant a variance from the minimum parking requirements for a residential use. The Council also found that the Precise Plan of Design could be justified. SECTION 2. Based on the foregoing, the City Council of the City of Azusa hereby reverses the decision of the Planning Commission denying Variance No. V-92-3 and Precise Plan of Design No. P-92-17 thereby granting the appeal of the property owner at 916 East Nearfield Street. In reversing the decision of the Planning Commission, the City Council vacates the findings of fact in Resolution Nos. 92-29 and 92-30. Variance No. V-92-3 and Precise Plan of Design No. P-92-17 are each hereby granted. SECTION 3.
