RESOLUTION NO. 92-C37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, CALIFORNIA, DENYING AN APPEAL OF
ABATEMENT OF ABANDONED SIGNS AT 585-647 EAST
FOOTHILL BOULEVARD.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Azusa does
hereby find, determine and declare as follows:
A. Or. January 15, 1992 the Planning Commission of the City
of Azusa denied an appeal on the abatement of abandoned signs on
property located at 585-647 East Foothill Boulevard at a public
hearing which was duly noticed;
B. After reviewing photographs of the signs, hearing
testimony and reviewing comments and statements expressed by all
those present at the hearing, the Planning Commission denied the
appeal of abatement of the abandoned signs;
C. Thereafter the property owner filed a timely appeal to
the City Council;
D. On March 16, 1992, after proper notice being duly
given, the hearing was held before the City Council of the City
of Azusa on the property owner's appeal of the abatement of the
abandoned signs and the Planning Commission's denial of the
property owner's appeal thereon;
E. On the afternoon of March 16, 1992 the property owner's
attorney submitted a letter arguing that there was no "intent to
abandon" manifested with regard to the signs to be abated;
F. The signs to be abated and the dates of abandonment are
as follows:
(a) The pylon sign formerly used by Thrifty Drug Store.
This sign was damaged in 1986 and was never repaired. Thrifty
Drug Store went out of business on September 30, 1987 and the
sign has never been used since then.
(b) A rooftop sign at 587 East Foothill Boulevard. This
sign advertised the Fashion Barn. The Fashion -Barn went out of
business on January 31, 1988. The sign has never been used since
then.

(c) A sign for the Azusa Bowl. The Azusa Bowl went out of
business on April 30, 1991. The sign has never been used since
then.
(d) After hearing testimony from staff, the property
owner's attorney and interested members of the public, reviewing
the staff report and pictures of the signs to be abated, the City
Council determined: (a) There was an intent to abandon each of
the signs to be abated which was manifested by the length of time
the signs had been unused, the condition of the signs, and the
failure to maintain or improve the signs or to manifest any
control of any kind over them; (b) There was no independent
evidence that the property owner had made any attempt to lease
any of the vacant properties for which the signs were originally
intended; (c) As an independent finding, it was determined that
the -signs, because of their deteriorated condition and the
numerous complaints of residents testified to by the Director of
Community Development constitute an aesthetic blight and, even if
they were not abandoned, so affect the surrounding property in a
negative way that they constitute a public nuisance.
SECTION 2. Based on the foregoing, the City Council of the
City of Azusa hereby upholds the action of the Planning Commis-
sion in denying the appeal on the abatement of abandoned signs on
the property located at 585-647 East Foothill Boulevard.
The Council finds that the signs can be abated under two separate
grounds:
1. That they are abandoned signs pursuant to Section
19.50.120 of the Azusa Municipal Code and must therefore be
removed within thirty (30) days.
2. Council finds that signs constitute an aesthetic blight
and therefore a public nuisance which negatively impact all of
the surrounding properties due to their size, visual impact, and
deteriorated condition.
The original order of abatement is hereby confirmed and the
property owner shall have thirty (30) days from the date of the
adoption of this Resolution to remove the abated signs.
SECTION 3. The City Clerk shall certify the adoption of
this Resolution.
