A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AZUSA, CALIFORNIA CERTIFYING A NEGATIVE
DECLARATION FOR ZONE CHANGE NO. Z-92-1,
CONDITIONAL USE PERMIT C-92-3, VARIANCE NO.
V-92-4 AND PRECISE PLAN OF DESIGN NO. P-92-30
REGARDING PROPERTY AT 240-600 WEST FOOTHILL
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to the State CEQA guidelines, a
negative declaration has been prepared and reviewed, finding that
the proposed project could not have a significant effect on the
environment. The City Council hereby certifies said negative
declaration, with the provision that the mitigation measures, if
any, recommended in the initial study, are implemented.
SECTION 2. The City Clerk shall certify to the
adoption of this Resolution.
ADOPTED AND APPROVED THIS 15th DAY OF June 1992.
I HEREBY CERTIFY that the foregoing Resolution was duly
adopted by the City Council of the City of Azusa at a meeting
thereof held on thel5th day of June 1992 by the
following vote of the Council:

NOTICE: Pursuant to the provisions of the California Environmental
Quality Act (CEQA-Public Resources Code, Section 21100 at. seg.),
the City of Azusa has determined that the project referenced
hereinafter will not have a significant effect on the environment.

A copy of the Initial Study, documenting reasons to support the
findings that said project will not have a significant effect and
containing any mitigating measures proposed to be included in the
project to avoid potentially significant effects, is attached
hereto for public review.
An Environmental Impact Report is not required for this project.
APPEALS. Any person or agency aggrieved by this decision may appeal
to the Azusa City Council in compliance with all provisions for
filing of such appeals. Any such appeal must be filed within thirty
(30).days after the issuance of this decision, or it shall be dis-
missed by the City Council.

On the basis of this initial evaluation:
I find the proposed project COULD NOT HAVE a significant
effect on the environment, and a NEGATIVE DECARATION has
been prepared and is attached.
X I find that although the proposed project could have a
significant effect on the environment, there will not be a
significant effect in this case because the mitigation
measures described on an attached sheet have been added to
the project. A NEGATIVE DECLARATION WILL BE PREPARED.
I find the proposed project MAY have a significant effect
effect on the environment and an ENVIRONMENTAL IMPACT
REPORT is required.

EXPLANATIONS/MITIGATION DISCUSSION
III. DISCUSSION OF ENVIRONMENTAL
1.a. Grading hnd compaction of the soil will occur as a result
of construction activities on a currently vacant lot.
2.a. Fugitive dust from construction equipment and activities
may be generated by the project.
3.b. Absorption rates and drainage patterns may be altered due
to substantial paving and construction of structures on
the property.
6.a. construction equipment and activities may cause an
increase in ambient noise levels. The proposed batting
cage facility may also increase noise levels due to ball
ejection equipment and facility users.
8. a. Q. The proposed batting cage facility will be constructed on
an undeveloped vacant lot. The current zone designation
of the parcel, Central Business District (CBD) does not
permit the proposed use. The City is initiating a zone
change from CBD t-3 Restricted Commercial (C2) for all CBD
parcels south of Foothill Boulevard between San Gabriel
and Louise Avenue. That area includes the subject
property. The C2 zone designation will be consistent
with the type of commercial development desired for that
area. Also, the proposed batting cages would be
conditionally permitted within the C2 zone. A
conditional use permit has also been submitted for the
proposed use.
13.a.&b. The proposed use will involve increased demands on
traffic patterns and parking areas. The existing
circulation system and proposed off-street parking
appears adequate to handle these increases.
19. This commercial batting cage facility will increase by
one (1) the number of private recreational opportunities
available within the community.

IV. MITIGATION MEASURES
l.a. Both grading and drainage plans shall be submitted for
review by the City Engineer.
2.a. The construction site shall be required to be watered
down to eliminate fugitive dust.
3.b. Both grading and drainage plans shall be submitted for
review by the City Engineer.
6.a. All construction and batting cage activities shall comply
with the Azusa Noise Ordinance (Chapter 8.58 of the Azusa
Municipal Code). The property is a corner lot with no
adjacent residential uses. Concrete block wall provided
on the south and west property lines should reduce noise
heard from surrounding residential neighborhoods.
13.b. If provided parking does not meet demand then the vacant
parcel to the south shall be developed to provide
additional parking. A parking study shall be conducted
at the end of six months to evaluate existing conditions.
Reference is also hereby made to all other Environmental Impact
Reports which have been prepared for projects within the City of
Azusa Por additional information and knowledge of existing and
future environmental conditions in the area.
