A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF AZUSA DENYING AN APPEAL BY
FILOMENQ MARTINEZ OF THE PLANNING COMMISSI(
DECISION TO DENY VARIANCE V-92-9
AND PRECISE PIAN OF DESIGN P-92-78
WHEREAS, an application was received from Filomena Martinez
for a precise plan of design and variance to legalize a garage
conversion with reduced parking, reduced rear and side yard
setbacks, and reduced minimum unit size (Precise Plan of Design No.
P-92-78 and Variance No. V-92-9), and
WHEREAS, the Planning Commission considered this request in a
duly noticed public hearing on July 29, 1992, and has carefully
considered all pertinent evidence and testimony, and
WHEREAS, the Planning Commission could not make the required
findings of fact, therefore denying the variance request, and
WHEREAS, the applicant has appealed the Planning Commission's
decision to the City Council, who held a duly noticed public
hearing on September 8, 1992, and
WHEREAS, the City Council of the City of ,Azusa carefully
considered all the pertinent evidence and testimony regarding
Precise Plan of Design No. P-91-78 and Variance No. V-92-9,
NOW THEREFORE, the City Council of the City of Azusa does hereby
resolve as follows:
SECTION 1. The City Council for the City of Azusa finds
that the granting of the Variance V-92-9 and the Precise Plan of
Design P-92-78 will cause an adverse effect on the public welfare,
in that insufficient garage spaces will cause an increase of street
parking along San Gabriel Avenue.
SECTION 2. The City Council for the City of Azusa finds
that the granting of the Variance V-91-9 and Precise Plan of Design
P-92-78 will cause an adverse effect on surrounding properties, in
that the reduction of the side yard setback will cause congestion
between neighboring structures.
SECTION 3. The City Council for the City of Azusa finds
that the granting of the Variance V-92-9 and Precise Plan of Design
P-92-78 will be inconsistent with the goals and objectives of the
Azusa General Plan, in that the garage conversion would not create
a fully functioning second dwelling unit with the minimum allowable
square footage of living space.
SECTION 4. The decision of the Planning Commission denying
Variance V-92-9 and Precise Plan of Design P-92-78 is hereby
upheld.
SECTION 5. The applicant shall have one year from the date
of the adoption of this resolution to relocate the existing tenants
and reconvert the unpermitted second unit back to its intended
purpose of a garage.
SECTION 6. The City Clerk shall certify to the adoption of
this resolution.
