RESOLUTION NO. 92-C119
A RESOLUTION OF THE CITY OF COUNCIL OF THE CITY
OF AZUSA ADOPTING COMPENSATION SYSTEM FOR HEADSTART/
PRE-SCHOOL EMPLOYEES TO BE EFFECTIVE JULY 1, 1992.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES RESOLVE AS
FOLLOWS:
SECTION 1. Whereas, the City of Azusa adopted
Resolution 8373 on February 1, 1988, approving the application
for licensing under the California Department of Social Services
for the Azusa Headstart/Pre-School Program;
SECTION 2. Whereas, it is appropriate to formally
establish salaries and benefits for employees of this program for
the fiscal year 1992-93;
SECTION 3. Now. therefore, be it resolved that the
City Council of the City of Azusa adopt the attached Exhibits A
and B establishing salaries and benefits for the employees
appointed to positions in the Headstart/Pre-School Program.
SECTION 4. The City Clerk shall certify to the adop-
tion of this resolution.

1. MANAGEMENT RIGHTS
The City reserves, retains and is vested with, solely and exclu-
sively, all rights of Management which have not been expressly
abridged by specific provision(s) of this resolution or by law to
manage the City, as such rights existed prior to the execution of
this resolution. The sole and exclusive rights of Management, as
they are not abridged by this resolution or by law, shall
include, but not be limited to, the following:
(1) To manage the City generally and to determine the
issues of policy.
(2) To determine the existence or nonexistence of facts
which are the basis of the Management decision.
(3) To determine the necessity and organization of any
service or activity conducted by the City and
expand or diminish services.
(4) To determine the nature, manner, means, and
technology, and extent of services to be provided
to the public.
(5) To determine methods of financing.
(6) To determine types of equipment or technology to be
used.
(7) To determine and/or change the facilities, methods,
technology, means, and size of the work force by
which the City operations are to be conducted.
(8) To determine and change the number of locations,
relocations, and types of operations, processes and
materials to be used in carrying out all City
functions including, but not limited to, the right
to contract for or subcontract any work or
operations of the City.
(9) To assign work to and schedule employees in
accordance with requirements as determined by the
City and to establish and change work schedules and
assignments.
(10) To relieve employees from duties for lack of funds
or lack of work or similar nondisciplinary reasons
(11) To establish and modify productivity and perform-
ance programs and standards.

(12) To discharge, suspend, demote or otherwise
discipline employees for proper cause.
(13) To determine job classification and to reclassify
employees.
(14) To hire, transfer, promote or demote employees for
nondisciplinary reasons in accordance with this
Memorandum of Understanding and applicable
Resolutions and Codes of the City.
(15) To determine policies, procedures and standards for
selection, training and promotion of employees.
(16) To establish employee performance standards includ-
ing, but not limited to, quality and quantity
standards and to require compliance therewith.
(17) To maintain order and efficiency in its facilities
and operation.
(18) To establish and promulgate and/or modify rules and
regulations to maintain order and safety in the
City which are not in contravention with this
Agreement.
(19) To take any and all necessary action to carry out
the mission of the City in emergencies.
2. SALARY
Salaries shall be according to the attached Salary Scale desig-
nated as "Exhibit B".
Starting salaries and advancement from one step to another will
be in accordance with departmental policy.
3. FORTY (40): THIRTY-FIVE (35): AND THIRTY (30) HOUR WORK WEER
POSITIONS
3.A. Fortv (40) -hour Work Week Positions
For the following positions, the full-time work week shall
be forty (40) hours per week, eight (8) hours per day,
twelve (12) months per year.
Headstart Coordinator (Area supervisor)
Typist/Clerk
3.A.1. Work Week
The regular work week for all employees covered by this
category shall be forty hours in a seven (7) day period

beginning at 12:01 a.m. each Sunday and consists of five (5)
days a week and eight (8) hours per day. Daily hours of
work or shifts for employees within departments shall be
assigned by the department head, as required to meet the
needs of the department.
3.8. Thirty-five (35) -hour Work Week Positions
For the following position, the work week shall be defined
as thirty (35) hours per week, seven (7) hours per day, ten
months per year.
Education Coordinator
3.B.1. Work Week
The regular work week for all employees covered by this
category shall be thirty-five (35) hours in a seven (7) day
period beginning at 12:01 a.m. each Sunday and consists of
five (5) days a week and seven (7) hours per day. Daily
hours of work or shifts for employees within departments
shall be assigned by the department head, as required to
meet the needs of the department.
3.C. Thirty (30) -hour Work Week Position
For the following classifications, the work week shall be
defined as thirty (30) hours per week, six (6) hours per
day, ten months per year.

Teacher II
Health Coordinator (RN)
3.C.1. Work Week
The regular work week for all employees covered by this
category shall be thirty hours in a seven (7) day
period beginning at 12:01 a.m. each Sunday and consists of
five (5) days a week and six (6) hours per day. Daily
hours of work or shifts for employees within departments
shall be assigned by the department head, as required to
meet the needs of the department.
3.D. Benefits
The following benefits shall apply to employees who work a
designated forty (40); thirty-five (35); and thirty (30) -
hour work week.
3.D.1. Bereavement Leave
An employee may be permitted to take up to five (5) days of
Bereavement Leave in the event of the death of a member of
his or her immediate family. "Immediate family" member is

herewith defined as a mother, father, brother, sister,
spouse child, mother-in-law, father-in-law, grandparents, or
relative living within the employee's household. Persons in
loco parentis may also be considered under certain
circumstances. Such leave shall not be charged against the
employee's sick leave or vacation leave.
In addition to Bereavement Leave, an employee may request up
to two (2) days of Sick Leave in the event of the death of
an immediate family member. Such leave shall be charged
against the employee's accrued Sick Leave balance.
3.D.2. Cafeteria Benefit Plan
The City will maintain the Cafeteria Benefit Plan (CBP) at
four hundred fifty-seven ($457) dollars per month.
The CBP funds may be used by the employee to pay for indivi-
dual and dependent health coverage, dental plan, supplemen-
tal life insurance, up to fifty percent (50%) of membership
fees for a health club or similar organization, deferred
compensation, supplemental insurances, or deposit funds to a
miscellaneous fund to be utilized according to the City's
policy, or any combination of these items. The employee
understands that in the event premiums and/or expense for
options selected by him/her exceeds the amount of the of the
CBP allotment, the excess shall be deducted from gross wages
of the employee.
Persons who are on payroll from September 1 through June 30
will continue to have their CBP paid for the months of July
and August. The Eligibility requirement for the CBP speci-
fied below does not apply to the months of July and August.
3.D.2.a. Elivibilit
In order for an employee to be eligible for the CBP in
any given month, he/she must be on payroll for fifteen
days within that month. If an employee does not meet
the qualifying work time, arrangements must be made
with the Finance Department to reimburse the City for
any benefits that have already been paid out on the
employee's behalf for that month. The Finance
Department will notify the employee if he/she has not
worked sufficient days to qualify for the CBP.
New employees will be eligible for the full CBP Plan if
they begin work prior to the 16th of the month.
Employees whose date of hire is on the 16th or
thereafter will not be eligible for CBP for that month.
3.D.2.b. Termination
It is agreed that the City will not be responsible for
payment of any insurance premium(s) on behalf of an

employee following the month of termination. If an
employee wishes to continue his or her benefits,
advance payment for such premium(s) will be deducted
from the CBP for the employee, or if he or she is not
eligible for this plan, then the deduction shall be
made from the employee's final paycheck.
3.D.3. Employee Assistance Plan
The City will provide an Employee Assistance Plan.
3.D.4. Holidays
The employee shall receive time off with pay for the
following holidays but only if the employee is paid for the
workday that precedes or follows the holiday:

In the event employees are laid off from their employment,
a minimum of fifteen (15) calendar days notice will be given
to each affected employee. Such notice shall be in writing
and signed by appropriate management employees.
3.D.6. Life Insurance
The City shall provide term life insurance equal to twelve
months of salary or $30,000, whichever is greater, excluding
overtime and other forms of supplemental compensation, for
each employee.
3.D.7. Lona Term Disability
The City will provide long-term disability insurance.
3.D.8. Sick Leave
Sick Leave shall not be construed as a right which an
employee may use at his or her discretion, but shall be
allowed only in case of necessity or actual sickness or
disability and shall accrue at the rate of one day per
month for each month worked, with unlimited accumulation.

3.D.9. Retirement
The City shall enroll eligible employees in the Public
Employees' Retirement System (PERS) under the 112% @ 60 full
formula" plan, and shall pay the entire employee's share as
a benefit.
4. TWENTY (20) HOUR WORK WEER POSITIONS
For the following positions, the work week shall be defined as
twenty (20) hours per week, four (4) hours per day, ten months
per year.
Assistant Teacher I
Assistant Teacher II
Social worker Aide
Health Aide I
Parent Involvement Aide
Typist Clerk
4.A. Work Week
The regular work week for all employees covered by this
category shall be twenty hours in a seven (7) day
period beginning at 12:01 a.m. each Sunday and consists of
five (5) days a week and four (4) hours per day, ten months
per year. Daily hours of work or shifts for employees
within departments shall be assigned by the department head,
as required to meet the needs of the department.
4.B. Benefits
The following benefits shall apply to employees who work a
designated twenty (20) hour work week.
4.B.1. Retirement
Employees who work less than an average of less than twenty
hours per week in a fiscal year shall be enrolled in the
Public Agency Retirement System. The City contributes 3.75%
of the employee's wages and the employee contributes 3.75%
of wages for this plan.
Employees who are current members of the Public Employees'
Retirement System shall be enrolled in accordance with
Retirement law. The City will pay the employer's share
only. The employee's share of 7% will be deducted from
wages.
4.B.2. Cafeteria Benefit Plan

4.8.3. Holiday Pay
Any part-time non -classified employee who is hired to work
twenty (20) or more hours each week on a consistent basis
throughout the school year shall be entitled to a pro -rated
holiday not to exceed one-half day (4 hours). Holidays
observed in 1992-93 shall be the following days provided the
employee is on the payroll the day before the holiday or the
day after. In the case of Christmas Day and New Year's Day
where employee's are on Winter Break, the employee must be

on the payroll the day before winter break begins (December
18, 1992) or on the day Winter Break ends (January 4, 1993).

S. FIFTEEN (15) HOUR WORK WEEK POSITIONS
For the following position, the work week shall be defined as
fifteen (15) hours per week, three (3) hours per day, ten months
per year. There are no benefits assigned to this category other
than those listed below..
Assistant Teacher I
S.A. Work Week
The regular work week for all employees covered by this
category shall be fifteen hours in a seven (7) day
period beginning at 12:01 a.m. each Sunday and consists of
five (5) days a week and three (3) hours per day, ten months
per year. Daily hours of work or shifts for employees
within departments shall be assigned by the department head,
as required to meet the needs of the department.
S.B. Retirement
Employees who work less than an average of less than twenty
hours per week in a fiscal year shall be enrolled in the
Public Agency Retirement System. The City contributes 3.75%
of the employee's wages and the employee contributes 3.75%
of wages for this plan.
Employees who are current members of the Public Employees'
Retirement System shall be enrolled in accordance with
Retirement law. The City will pay the employer's share
only. The employee's share of 7% will be deducted from
wages.

In compliance with FLSA, the minimum timekeeping interval shall
be fifteen (15) minutes. Periods of time of seven (7) minutes or
less shall be rounded down and periods of time of eight (8)
minutes or more shall be rounded up.

7. OVERTIME/COMPENSATORY TIME
Employees shall be entitled to overtime pay at the rate of time
and one-half base pay or compensatory time off at the rate of
time and one-half (i.e., one (1) hour worked equals one and one-
half (1 1/2) hours compensatory time earned) for all hours worked
in excess of eight (8) hours in one work day or forty (40) hours
within the employee's regular work week. For the purposes of
this category, holiday pay, sick leave, and other compensated
time off shall count for the hours.
Overtime pay or compensatory time off for overtime shall be
accumulated in no less than fifteen minutes per day increments.
When an employee works less than fifteen minutes per day of
overtime, the employee shall not receive compensatory time for
such overtime. In order to be entitled to any compensation for
overtime hours worked, such overtime work must have been
authorized by the department head or the City Administrator.
Accumulated compensatory time not taken off in the pay period in
which it was earned, may be carried over to a maximum accrual of
eighty (80) hours.
