NO. 92-0113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA AMENDING THE WEST END SPECIFIC PLAN TO ESTABLISH A MOBILEHOME PARR DISTRICT WITHIN THE SPECIFIC PLAN AND CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT CONCERNING SAID THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Azusa does hereby find, determine and declare as follows: A. The City Council of the City of Azusa has recently adopted an amendment to the City's Zoning Code adding a RMP (Residential Mobilehome Park) zoning classification. B. The geographical area covered by the West End Specific Plan currently contains two areas being used as mobilehome parks. Both of these areas have an HM (Heavy Manufacturing) land use designation and are each zoned SP -1 (Specific Plan). These mobilehome parks are located at 812 North Loren Avenue and 753 North Loren Avenue respectively. C. On May 13, 1992, the Planning Commission of the City of Azusa held a public hearing concerning the possible amendment of the West End Specific Plan to change the land use designation of these two mobilehome parks from HM to the new land use designation created in conjunction with the RMP zone which is known as MP (Mobilehome Park). Upon review, the Planning Commission recommended that no land use designation change should be made. D. On July 7, 1992, the Planning Commission's recommendation concerning the amendment of the West End Specific Plan was originally scheduled to be heard by the City Council that item was subsequently continued to the July 21, 1992 City Council meeting. At that meeting the City Council determined that the mobilehome parks were sufficiently appropriate uses, had been sufficiently improved and had a sufficiently long use expectancy that it would be appropriate to change the land use designation from HM to MP in order to protect the rights of the tenants and park owners. E. Government Code section 65453 provides that a specific plan may be amended by resolution or by ordinance as often as deemed necessary by the legislative body. SECTION 2. Based upon the foregoing findings of fact, the City Council of the City of Azusa does hereby amend the West End specific plan to redesignate the properties at 812 North -Loren Avenue and -753 North Loren Avenue from the HM -land use designation to the MP land use designation. SECTION 3. Pursuant to the State CEQA Guidelines, a Negative Declaration of Environmental Impact has been prepared and reviewed and is attached hereto as Exhibit A. This Negative Declaration determines that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said Negative Declaration, with the provision that the mitigation measures, if any, recommended in the initial study, are implemented. SECTION 4. This Resolution shall take effect 30 days from the date of adoption. 24679.1 0 0 SECTION 5. The City Clerk shall certify to the adoption of this Resolution. The proposed new land use designation would protect existing mobilehome residents from having their property redeveloped for nonindustrial purposes. IV. MITIGATION MEASURES Describe mitigation measures included in the project, if any are needed, to avoid potentially significant effects: None Required. DETERMINATION (To be completed by Lead Agency) On the basis of this initial evaluation: X I find the proposed project COULD NOT HAVE a significant effect on the environment, and a NEGATIVE DECARATION has been prepared and is attached. I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION WILL BE PREPARED. I find the proposed project MAY have a significant effect effect on the environment and an ENVIRONMENTAL IMPACT REPORT is required.
