HomeMy WebLinkAboutResolution No. 92-C1480 0 RESOLUTION NO. 92-C148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FINDING AND DETERMINING THAT THE ACQUISITION OF AN ENTITLEMENT IN THE SAN JUAN GENERATING STATION UNIT NO.3 AND ENTERING INTO A POWER SALES CONTRACT WITH THE SOUTHERN CALIFORNIA PUBLIC POWER AUTHORITY IS STATUTORY EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the Southern California Public Power Authority ("SCPPA") is considering approving and executing the San Juan Unit 3 Purchase Agreement with Century Power Corporation ("Century") whereby SCPPA would acquire from Century a 41.8% interest in Unit 3 of the San Juan Generating Station located in the State of New Mexico; and WHEREAS, the City of Azusa intends to enter into a Power Sales contract with SCPPA to purchase a portion of the output of SCPPA's entitlement in San Juan Unit No. 3; and WHEREAS, the output of SCPPA's entitlement would be delivered pursuant to the Power Sales Contract to the City at the Westwing 500 kV Switchyard (Arizona), the San Juan 345 kV Switchyard (New Mexico), the Palo Verde Nuclear Generating Station Switching Station (Arizona) or at such time as the Shiprock-Four Corners Transmission Line is converted to 345 kV (estimated 1994), the Four Corners 345 kV Switchyard (New Mexico); and WHEREAS, Section 21080(b)(15) of the Public Resources Code of the State of California and Section 15277 of the Guidelines adopted by the Resources Agency of the State of California provide that a project or portion thereof located in another state which will be subject to the environmental impact review pursuant to the National Environmental Policy Act of 1969 is statutorily exempt from the California Environmental Quality Act of the State of California; and WHEREAS, the San Juan Generating Station was constructed pursuant to an Environmental Impact Statement prepared under the National Environmental Policy Act of 1969. NOW, THEREFORE, the City Council of the City of Azusa, California, does hereby resolve, determine and order: Section 1. The approval and execution of the Power Sales Contract and related agreements constitute a project under the California Environmental Quality Act. Section 2. That said project is statutorily exempt under the California Environmental Quality Act. Section 3. That the City Clerk is authorized and directed to file a Notice of Determination of this action with the County Clerk in Los Angeles County and to take such further action to implement this Resolution as is appropriate.
