E RESOLUTION NO. 93-C48 u A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING AN UNDERGROUND UTILITY DISTRICT AND ORDERING REMOVAL AND UNDERGROUND INSTALLATION OF UTILITIES WITHIN SAID DISTRICT THE CITY COUNCIL OF THE CITY OF AZUSA HEREBY FINDS, , RESOLVES AND ORDERS AS FOLLOWS: SECTION 1. Pursuant to Chapter 13.04 of the Azusa Municipal Code, the City Council of the City of Azusa called a public hearing to ascertain whether the public necessity, health, safety or welfare required the removal of poles, overhead wires and associated overhead structures within a designated area of the City as described in Attachment A attached hereto and incorporated by this reference (the "District") and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within the District. SECTION 2. The public hearing was set for April 5, 1993 at 7:30 p.m. in the Azusa City Council Chambers. Notice of said hearing was mailed to all affected property owners as shown on the last equalized assessment roll and utilities concerned at least ten days prior to the hearing. SECTION 3. Prior to the public hearing, the City Engineer prepared a written report relating to the establishment of the District entitled "Underground Utility District No. 93-1" and said report was submitted and received by the City Council. The City Engineer's report was on file in the office of the City Clerk prior to the public hearing. SECTION 4. The City Council of the City of Azusa considered the information contained in said report and heard all public comment raised at the hearing.-- -- SECTION 5. The City Council of the City of Azusa hereby 1. Finds that the public necessity, health, safety or welfare requires the removal and underground installation of utility lines within the District; 2. Declares the District to be an underground utility district; 3. Orders the removal and underground installation of utility lines within the District. SECTION 6. Said removal and underground installation shall be accomplished and affected property owners must be ready to receive underground service no later than October 7, 1993. The City Council requires all utility companies to underground all overhead structures, poles, wires and within 100 feet of each property owner's service lateral at utility's expense in accordance with the provisions of Rule 20A filed with and approved by the California Public Utilities Commission. - SECTION 7. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 93-1 of the adoption of this resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property KTF\1883.R • 0 desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide or cause the provision of all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this resolution together with a copy of said Chapter 13.04, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 8. The City Council hereby orders the City Clerk to certify to the passage of adoption of this resolution and the minutes of this meeting shall so reflect the presentation of the Engineer's Report.
