HomeMy WebLinkAboutResolution No. 93-C0860 0 RESOLUTION NO. 93-C86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA FIXING AND ESTABLISHING THE RATES TO BE CHARGED FOR WATER PROVIDED TO CUSTOMERS OF THE AZUSA VALLEY WATER COMPANY BY THE CITY OF AZUSA WHEREAS, the City of Azusa, through its joint power authority, the Azusa Public Financing Authority (the "Authority"), issued its 1993 Series A Revenue Bonds, the proceeds of which are, among other things, to be used to acquire the right to operate the water system of the Azusa Valley Water Company; and WHEREAS, the City of Azusa, Azusa Public Financing Authority and the Azusa Public Improvement Corporation entered into and executed the "Operating and Assignment Agreement", dated June 1, 1993; and WHEREAS, the Operating Agreement provides that the Authority shall assign such rights to operate the water system and to receive the revenues therefrom to the City in return for Operating Payments, which Operating Payments will be calculated to be sufficient to pay the principal of and interest on the Bonds as the same shall become due; and WHEREAS, the City proposes to operate such newly acquired water system as a part of its existing municipal water system (together the "Enterprise"); Now, therefore, the City Council of the City of Azusa resolves as follows: SECTION 1. Pursuant to Section 16.20.020 of the Azusa Municipal Code, the City Council of the City of Azusa hereby adopts the water rates and charges for the customers of Azusa Valley Water Company as set forth in Exhibit "A", attached to this Resolution. Water rates for current customers of the City shall remain as presently in effect. SECTION 2. The City Council finds that pursuant to Section 15079.1 of the State CEQA Guidelines (14 Cal. Admin. Code Sec. 15079.1) that CEQA is not applicable to the approval of the rates and charges set forth herein because such rates and charges are for the purpose of: (1) Meeting operation expenses, including employee wage rats and fringe benefits and departmental operations; (2) Purchasing or leasing of supplies, equipment or materials, (3) Meeting financial reserve needs and requirements; (4) Obtaining funds for capital projects necessary to maintain a service within existing service areas. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. 0 0 Resolution No. 93-C86 Page 2 PASSED, APPROVED AND ADOPTED this 19th day of July, 1993.
