HomeMy WebLinkAboutResolution No. 93-C148RESOLUTION N0.93 -C148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING AN APPEAL OF THE PLANNING COMMISSION DECISION TO DENY CONDITIONAL USE PERMIT NO. C-93-10, VARIANCE NO. V-93-10 AND PRECISE PLAN OF DESIGN P-93-99 WHEREAS, an application was received from D.R. Butler and Kunz Outdoor Advertising Company for a conditional use permit, variance and precise plan of design to construct a billboard within 660 feet of the 210 Freeway on property located on the south side of the 210 Freeway east of Irwindale Avenue (Conditional Use permit No. C-93- 10, Variance No. V-93-10 and Precise Plan of Design No. P-93-99), and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on October 27, 1993, and has carefully considered all pertinent evidence and testimony, and WHEREAS, the Planning Commission could not make the required findings of fact, therefore denying the conditional use permit, variance and precise plan of design request, and WHEREAS, the applicant has appealed the Planning Commission's decision, and The City Council has held a duly noticed public hearing on December 6, 1993, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Conditional Use Permit No. C-93-10, Variance No. V-93-10 and Precise Plan of Design No. P-93-99, NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows: SECTION 1. The City Council for the City of Azusa finds that the granting of Conditional Use Permit No. C-93-10 and Precise Plan of Design No. P-93-99 are justified as the proposed billboard is not contrary to the Azusa General Plan. The billboard will have limited impacts on surrounding properties due to its lack of visibility from other sites. The proposed site can support the requested billboard, with the appropriate granting of the requested variance. The billboard is consistent with the overall intent objectives for signage in Azusa. SECTION 2. The City Council for the City of Azusa finds that the granting of Variance V-93-10 is justified by an unnecessary hardship, in that the denial of this billboard would deprive the property owner of the only viable use of this property permitted by its M-2 zoning. SECTION 3. The City Council for the City of Azusa finds that the granting of Variance V-93-10 is justified by an exceptional circumstance, in that this parcel is one of a very limited number of landlocked parcels adjacent to the 210 Freeway within the City of Azusa. SECTION 4. The City Council for the City of Azusa finds that the granting of Variance V-93-10 will not cause an adverse effect on surrounding properties, in that the billboard will not be visible from other nearby industrial uses due to its location at the base of a steeply sloped area. The City Council for the City of Azusa finds that the granting of Variance V-93-10 will be not be contrary to the goals and objectives of the Azusa General Plan, in that there are no clear objectives established within the General Plan to deal with the issue of off -premise signs located along the 210 Freeway. SECTION 6. The decision of the Planning Commission denying Conditional Use Permit No. C-93-10, Variance V-93-10 and Precise Plan of Design P-93-99 is hereby overturned, and the appeal is granted. SECTION 7. The City Clerk shall certify to the adoption of this resolution. ADOPTED AND APPROVED this 20th day of December , 1993.
