HomeMy WebLinkAboutResolution No. 94-C168RESOLUTION NO. 94-C168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING AN APPEAL BY IDEAL OUTDOOR ADVERTISING/KEN SPIKER AND ASSOCIATES OF THE PLANNING COMMISSION DECISION TO DENY CONDITIONAL USE PERMIT NO. C-94-7, VARIANCE NO. V-94-12 AND PRECISE PLAN OF DESIGN P-94-96 WHEREAS, an application was received from Ca1Mat, Ideal Outdoor Advertising and Ken Spiker and Associates for a conditional use permit, variance and precise plan of design to permit construction of a billboard within 660 feet of the 210 Freeway (Conditional Use Permit No. C-94-7, Variance No. V-94-12 and Precise Plan of Design No. P-94-96), and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on September 28, 1994, and has carefully considered all pertinent evidence and testimony, and WHEREAS, the Planning Commission could not make the required findings of fact, therefore adopting Resolution Nos. 94-60, 94-61 and 94-62 denying the conditional use permit, variance and precise plan of design request, and WHEREAS, the applicant has appealed the Planning Commission's decision to the City Council, who held a duly noticed public hearing on November 7, 1994, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Conditional Use Permit No. C-94-7, Variance No. V-94-12 and Precise Plan of Design No. P-94-96, NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows: SECTION 1. The City Council for the City of Azusa finds that the proposed billboard is not supported by clear policy within the Azusa General Plan. The billboard would block a portion of the view of the largest commercial business in Azusa from the freeway, reducing the value of adjacent property and therefore becoming materially detrimental to the use and valuation of this property. Without a variance for the required setback from the freeway, the site is not adequate in size or shape to meet the City's standards for a billboard. The site has adequate access for the minimal traffic necessary to provide routine service to the billboard. SECTION 2. The City Council for the City of Azusa finds that the intent of Section 19.50.030 of the Azusa Municipal Code is to restrict off -premise signs which can be viewed from the freeway. The subject property does not have adequate dimensions to support such a sign while keeping 660 feet from the roadway. However, any inconvenience caused by the size of this parcel is also shared by almost all parcels in Azusa which have freeway frontage. Any hardship which must be borne by owners of freeway parcels in meeting these setback requirements has been considered to be necessary by the City to ensure the visual character of the freeway as it passes through Azusa. The only hardship imposed by the 660 foot setback requirement is consistent with the general purpose and intent of Chapter 19.52. SECTION 3. The City Council for the City of Azusa finds that the only other parcel in Azusa upon which a freeway -oriented billboard is located is situated directly across the freeway from this site. These two parcels are the only vacant industrially zoned lots adjacent to the freeway in the city, and are both adjacent to other parcels already developed with billboards facing the freeway. These characteristics create exceptional circumstances which do not generally apply to other parcels. Page 1 of 2 ® 0 RESOLUTION NO. 94-C168 PAGE 2 OF 2 SECTION 4. The City Council for the City of Azusa finds that the location of the proposed billboard would effectively limit the visibility of the Price Club from eastbound freeway traffic. The installation of a billboard at this location could also impact the ability of the City to redevelop the pit in which the sign is to be located as a commercial site by making it difficult to design a viable development around a prominent billboard. Reducing the freeway visibility for a major commercial enterprise and hindering future commercial development of the site would cause significant harm to the value of this and adjacent parcels. SECTION 5. The City Council of the City of Azusa finds that there are no clear objectives established within the Azusa General Plan to deal with the issue of off -premise signs located along the 210 Freeway. The ability of this freeway corridor to become a designated scenic route, as defined by the Scenic Highways Element, does depend, in part, on the evaluation of certain standards. These standards include limiting the size, height and number of off -premise signs. other than this potential issue, the proposed request would not be contrary to the objectives of the Azusa General Plan. SECTION 6. The decision of the Planning Commission denying Conditional Use Permit No. C-94-7, Variance No. V-94-12 and Precise Plan of Design P-94-96 is hereby upheld. SECTION 7. The City Clerk shall certify to the adoption of this resolution. ADOPTED AND APPROVED this 5th day of December , 1994.
