A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA, CALIFORNIA, RECOMMENDING THE DELETION OF
ROUTE 39 (AZUSA AND SAN GABRIEL AVENUES) FROM THE
STATE HIGHWAY SYSTEM AND ACCEPTING THE JURISDICTION
OF THE SAME
WHEREAS, the City Council of Azusa adopted
Resolution number 94-C44 on the 21st day of March 1994,
and declared its intention to accept the jurisdiction of
Route 39, within its City boundaries, from the state of
California; and
WHEREAS, the City and the State Department of
Transportation, hereinafter CalTrans, conducted
discussions and set forth the conditions of Highway
ownership transfer in a Memorandum of Understanding (MOU);
and
WHEREAS, the City of Azusa held a duly noticed
Public Hearing to recommend deletion of this portion of
Route 39 from the State Highway System and received
testimony from all individuals and groups interested on
Feb. 21, 1995; and
Whereas, the City Council of Azusa finds the
deletion of Route 39 from the State Highway System and the
transfer of ownership from the State of California to the
City of Azusa in the best interest of this community,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
AZUSA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City of Azusa recommends the deletion
of Route 39 from the State Highway System, and will accept
the jurisdiction of Route 39, Azusa and San Gabriel
Avenues, within the City limits, from Arrow Highway to
northerly City boundary, upon the recordation of the
Relinquishment Resolution at the County Recorder's office.
SECTION 2. The City of Azusa concurs with the
Memorandum of Understanding from the State Department of
Transportation
SECTION 3. The City of Azusa will accept a lump sum
payment from CalTrans as State's obligation to place the
roadway in good repair as outlined in the MOU.

SECTION 4. The said lump sum payment will be set
aside in a special Capital Improvement Expenditure account
for improvements on Azusa and San Gabriel Avenues.
SECTION 5. The City Clerk shall certify to the
adoption of this Resolution.

9MORANDUM OF UNDERSTANDING*
This is a "Memorandum of Understanding" (MOU) between the
State of California, Department of Transportation (Caltrans) and
the City of Azusa (City) covering the project development and
construction phases for the improvement and rehabilitation prior to
relinquishment of Azusa Avenue (State Route 39) between Arrow
Highway and North City limits of Azusa. It constitutes solely a
guide to the obligations, intentions, and policies of the parties
involved. It is not intended to authorize funding or project
effort, nor is it a legally binding contract. Funding commitments
providing for the deposit of funds or specific work phase will be
covered by a separate cooperative agreement.
The following responsibilities have been identified and are
proposed to be agreed to by both parties:
1. City will conduct a public hearing as part of the
requirement to delete the portion of State Route 39 from
the State Highway System and provide four copies of the
public hearing report to Caltrans.
2. Caltrans will relinquish to City that portion of State
Route 39 and the City will accept said relinquishment.
3. Caltrans and City have reached an understanding on the
work necessary to place the highway in a state of good
repair and determined the estimated amount of $3,350,000
in 1994 dollars as the cost to perform such work. The
amount is itemized in Exhibit A (attached) hereto made a
part of this MOU. An annual adjustment will be applied
to the amount itemized based on the Southern California
Consumer Price Index. It is the understanding of the
parties that this estimate is based upon conditions in
1994. Should there be any substantial worsening of the
condition of the highway after that date, the additional
costs of repairing the highway shall be added to that
total estimate, as adjusted.
4. Caltrans will make a lump sum payment to City upon an
agreed amount to be covered by a cooperative agreement.
5. City will accept a lump sum payment as Caltrans' total
responsibility and obligation to place highway in a state
of good repair for the purpose of relinquishing highway
to City.
6. Caltrans will prepare a cooperative agreement defining
more specifically the roles, responsibilities, and costs
involved in placing the highway iyn�state of good repair.
