A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF AZUSA DENYING AN APPEAL BY
PROGRESSIVE BUDDHIST ASSOCIATION
OF THE PLANNING COMMISSION
DECISION TO DENY CONDITIONAL USE PERMIT NO. C-94-9
AND PRECISE PLAN OF DESIGN P-94-120
WHEREAS, an application was received from the Progressive
Buddhist Association for a conditional use permit and precise plan
of design to expand and existing retreat center to construct a
9,200 square foot multi-purpose hall (Conditional Use Permit No. 0-
94-9 and Precise Plan of Design No. P-94-120), and
WHEREAS, the Planning Commission considered this request in a
duly noticed public hearing on November 30, 1994, and has carefully
considered all pertinent evidence and testimony, and
WHEREAS, the Planning Commission could not make the required
findings of fact, therefore adopting Resolution Nos. 94-82 and 94-
83 denying the conditional use permit and precise plan of design
request, and
WHEREAS, the applicant has appealed the Planning Commission's
decision to the City Council, who held a duly noticed public
hearing on January 17, 1995, and
WHEREAS, the City Council of the City of Azusa carefully
considered all the pertinent evidence and testimony regarding
Conditional Use Permit No. C-94-9 and Precise Plan of Design No. P-
94-120,
NOW THEREFORE, the City Council of the City of Azusa does hereby
resolve as follows:
SECTION 1. The City Council for the City of Azusa finds
that the Rural Residential land use designation contained within
the Land Use Element of the Azusa General Plan states that areas
such as this site are "suitable for further residential
development, but at very low densities." Although no mention is
made of the possible intensity of development of nonresidential
uses, the intent is clear that these areas should be developed in
a manner compatible with a low density rural environment. The
establishment and operation of a large multi-purpose building
needing 74 parking spaces would raise the activity levels on this
site above those found in the surrounding low density areas. This
expansion of the retreat would therefore be inconsistent with the
objectives of the Azusa General Plan for Rural Residential uses.
SECTION 2. The City Council for the City of Azusa finds
that neighboring property owners have complained about noise and
traffic from some of the activities of the retreat center. This
has disturbed the peace and quiet of residents of this rural area,
and been detrimental to the enjoyment of their property.
Gatherings at the church would not likely result in any menace to
the public health, but the increased traffic levels could create
safety problems on the narrow street serving the property.
SECTION 3. The City Council for the City of Azusa finds
that there appears to be adequate are on the site to construct the
proposed multi-purpose hall and the parking areas needed to support
its use. This level of construction would, however, result in a
large paved parking lot at the front of the property, along with a
35 foot high structure and attendant parking lot at the rear. This
level of construction is not compatible with the lower intensity of
development which occurs on most other rural properties in the
area.

SECTION 4. The City Council for the City of Azusa finds
that Azusa and San Gabriel Canyon Road is a narrow street which is
intended to provide access for the rural residents along this road
and secondary access for the adjacent condominium complexes. Most
other nonresidential uses in this area, such as the nearby Eagles
lodge and Mormon church, rely on the higher traffic capacity of
Highway 39 to provide for their traffic demand during peak times.
The amount of traffic which could arrive or depart from the
proposed multi-purpose hall at any one time could create serious
congestion along the only road serving the site.
SECTION 5. The decision of the Planning Commission denying
Conditional Use Permit No. C-94-9 and Precise Plan of Design P-94-
120 is hereby upheld.
SECTION 6. The City Clerk shall certify to the adoption of
this resolution.
