HomeMy WebLinkAboutResolution No. 95-C570 0 NO. 95-057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING VARIANCE NO. V-95-2 WHEREAS, an application was received from Johnny Johnson/Van Daele Development Corporation for a variance to allow waiver of minimum second story setback requirements and reduced setbacks for future patio covers and balconies on property located at 475 West Sierra Madre Avenue (Variance No. V-95-2), and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on March 15, 1995, and has carefully considered all pertinent evidence and testimony, and WHEREAS, the Planning Commission adopted Resolution No. 95-15 recommending to the City Council that this variance be approved, and WHEREAS, the City Council has held a duly noticed public hearing on April 17, 1995, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Variance No. V-95-2. NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows: SECTION 1. The City Council for the City of Azusa finds that the strict application of the zoning of the site would impose practical difficulties or unnecessary hardships on the site because the changing Southern California housing market has created a demand for homes with larger second story areas. The developer has managed to design a series of floor plans which meet the intent of the second story setback ordinance to provide a sense of visual relief, but finds it difficult to reduce the floor area on the second stories to meet the required setbacks. The future patios and balconies are consistent with additions that most homeowners are allowed to construct. Forcing the developer and future homeowners to restrict the second story areas and structural additions beyond the intent of the zoning code and normal residential expectations is an unnecessary hardship. SECTION 2. The City Council for the City of Azusa finds that the design of the individual lots is dependent on the shape of the overall site, which results in house designs which must maximize their utility on both floors in order to meet current housing demands. These homes have limited rear yards, but many of the units face nonresidential uses. These characteristics are exceptional circumstances which do not generally apply to other residential sites in Azusa. SECTION 3. The City Council for the City of Azusa finds that the golf course which buffers this property from neighboring homes minimizes the visual impacts which the larger second story areas and future balconies and patio covers would have on nearby residents. As these improvements will generally not be visible from other neighborhoods, the requested housing and addition designs will have no negative impacts on surrounding properties. SECTION 4. The City Council for the City of Azusa finds that the design of the proposed homes and future patio cover and balcony additions do not compromise the Medium Density Residential characteristics of this project, as designated for this site by the Land Use Element of the Azusa General Plan. That based on the above findings, the City Council grants that Variance Case No. V-95-2 be approved for the property located at: 475 WEST SIERRA MADRE AVENUE, subject to the conditions of approval listed in the attached Exhibit 'A'. SECTION 6. The City Clerk shall certify to the adoption of this resolution. ADOPTED AND APPROVED this 1st day of MAY , 1995. 'J ' STEPHEN J.
