Carried by the following vote of the Council: Ayes: Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. A communication signed by E. J. Ellis relative to the contacts on Two Neon Signs, was read. Moved by Councilman Owens, seconded by Council- man Malone that the Mayor and City Clerk be authorized and instructed to sign the contacts, ' upon approval of the City Attorney, between the City of Azusa and the Ellis Neon Company, covering service on two Neon Signs, one located at the intersection of Garvey Road and Azusa Avenue, the other at Foothill Boulevard and Azusa Avenue. Carried by the following vote of the Council: Ayes: Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. Notification of Liquor License Application to the State Board of Equalization by Juan Morales for an Off Sale Beer & Wine License, was read. It was unanimously agreed that this application be protested upon the grounds that the property location is within 200 feet of a church and approximately one-half block from the public school; that children and church goers and women shoppers may be inconvenienced and annoyed by a liquor house in this location; that the City Council of the City of Azusa now has before it for adoption a new Zoning Ordinance drawn in conformity with the most ' approved practice and this Ordinance zones this property location as residence property, there- fore the use of said property as a liquor sell- ing establishment is prohibited and to grant such a license is contrary to the best interest, welfare and morals of the community. Carried by the following vote of the Council: Ayes; Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. The "Notice of Hearing" on application made by the Southern Counties Gas Company for Franchise within the City of Azusa to be held before the Railroad Commission on Friday,. February 24, 1939, was read. Moved by Councilman Strohmeier, seconded by Councilman Owens and duly carried that the Railroad Commission be granted permission to use the Auditorium for said meeting. Carried by the following vote of the Council: Ayes: Councilmen; Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. A communication from the Pacific Electric Railway Company relative to the Vernon Avenue -crossing, was read. Moved by Councilman Strohmeier, seconded by Councilman Jumper that the Mayor and City Clerk be authorized and instructed to sign a check in the amount of $2280, drawn in favor of the Pacific Electric Railway Company for the con- struction of rails and signals at Vernon Avenue crossing; the Clerk to request the Pacific Electric Railway Company to go forward with the work as rapidly as possible as the City Coun- cil are unable to finish the construction of Vernon Avenue until the crossing has been completed. Mayor and City Clerk authorized to sign contracts with Neon Sign Company. Application for liquor license protested. Southern Counties Gas Company granted permission to use Auditorium. Councilman Strohmeier offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, TRANS- FERRING THE SUM OF 70LVE HUNDRED AND SIXTY ' DOLLARS($1260) FROM THE GENERAL FUND TO THE LOS ANGELES COUNTY HIGHWAY FUND. Moved by Councilman Strohmeier, seconded by Councilman Owens that this Resolution be adopt- ed as read and numbered Resolution No. 1602. Carried by the following vote of the Council:' Ayes: Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. Mr. Augustine Granados, representing Luis Ortez, appeared before the Council relative to Mr. Ortezf request to operate a nursery at 153 Azusa Avenue. No action taken. Moved by Councilman Strohmeier, seconded by Councilman Malone that the Richfield Oil Company be granted permission to construct a driveway for the Service Station located on corner of San Gabriel Avenue and Foothill Boulevard. The Richfield Oil Company to do the work under the supervision of the City Engineer and Street Superintendent, and to ' assume all responsibility and expense thereof. Carried by the following vote of the Council: Ayes: Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. Moved by Councilman Strohmeier, seconded by Councilman Malone that the City Council meet with the Superintendent of Light and Power, the Superintendent of Line Construction and the Auditor to make a careful study of the electrical rates in the first and second bracket for the purpose of reducing such rates, if found advisable. Carried by the following vote of the Council: Ayes: Councilmen: Jumper, Malone, Owens, Strohmeier, Arnold. Noes: None. Absent: None. RESOLUTION NO. 1602 ADOPTED. Councilman Strohmeier offered an Ordinance entitled: All ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILDINGS HEREAFTER ERECTED OR ALTERED; TO REGULATE AND DETERMINE THE AREA OF YARDS, AND OTHER OPEN SPACES; AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO DISTRICTS, TO PRE- SCRIBE PENALTIES FOR THE VIOLATION OF ITS PRO- VISIONS, TO PROVIDE FOR ITS ENFORCEMENT, AND TO REPEAL PRESENT ORDINANCES NOS. 294, 296, 3210 and 325, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. to be placed upon its second reading. DIoved by Councilman Strohmeier, seconded by Councilman Owens that the Mayor appoint City Attorney Miller and Street Superintendent Arthur Wolfe to attend the sale of Los Angeles County Flood Control fence on February 28, 1939 at 10:00 o'clock, A. M. and authorizing them to purchase said second hand fence, providing the bid does not exceed the amount specified in the provision of State law regulating the purchase of materials made by a City of the Sixth Class. 131 ORDINANCE NO. 342 ADOPTED.
