HomeMy WebLinkAboutResolution No. 95-C510 0 RESOLUTION NO. 95-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AN AMENDMENT TO THE COMPENSATION AND BENEFITS MEMORANDUM COVERING THE CITY OF AZUSA AND THE EXECUTIVE MANAGEMENT EMPLOYEES AND AUTHORIZING THE REPRESENTATIVES OF MANAGEMENT TO SIGN THE AMENDMENT WHEREAS, a Compensation and Benefits Memorandum was approved and passed on January 4, 1994, and WHEREAS, the said Memorandum covers the period July 1, 1993 through July 31, 1996, and WHEREAS, the Executive Management employees of the City of Azusa are not covered by a meet -and -confer process, and WHEREAS, that very few Executive Management employees have achieved as many as 20 or 25 years of service to the City of Azusa, and WHEREAS, the subject employees have the ability, upon retirement, to receive up to 50% of their respective unused accumulated sick leave in cash, or to defer up to 50% of it to retirement investments or towards reimbursement of medical expenses during retirement, or to convert up to 100% of it to retirement service credit, or a combination of these options, and WHEREAS, the City of Azusa and the Executive Management employees agree that enhancements to Sick Leave Cash -out provisions would be worthwhile incentives and rewards for the subject employees, who, as a group, already have an excellent reputation for prudent use of leave, NOW, THEREFORE, BE IT RESOLVED that: 1. Section 11.5.4 of the Compensation & Benefits Memorandum shall be deleted in its entirety. 2. Anew Section 11.5.4 shall be added to the Memorandum, to read as follows: "11.5.4 Conversion to Cash Upon Separation. "Upon separation due to death (if he or she had attained permanent status) the employee's estate may receive fifty percent (50%) of his or her accrued Sick Leave balance in cash. "Upon disability retirement with at least five (5) years of service with the City of Azusa, the employee may convert fifty percent (50%) of his or her accrued Sick Leave balance to cash. "Upon voluntary separation with less than ten (10) cumulative years of service with the City of Azusa, the employee may convert fifty percent (50%) of his or her accrued Sick Leave balance to cash for hours in excess of three -hundred twenty (320) hours to a maximum payment of two hundred forty (240) hours. "Upon voluntary retirement with at least ten (10) cumulative years of service with the City of Azusa, the employee may convert fifty percent (50%) of his or her accrued Sick Leave balance to cash. 0 E "Upon voluntary separation with at least twenty-five (25) cumulative years of service with the City of Azusa, the employee may convert one -hundred percent (100%) of his or her accrued Sick Leave balance to cash." 3. A new Section 11.5.6 shall be added to the Memorandum, to read as follows: 11.5.6 Conversion to Service Credit Upon Retirement. "Pursuant to the terms of the City's contract, as amended, with the Public Employees' Retirement System, upon voluntary retirement the employee may convert 100% of his or her accrued Sick Leave balance, less any amount converted to cash under the provisions of Section 11.5.5, to retirement service credit." 4. The City Council does hereby approve the attached Amendment to the Compensation and Benefits Memorandum and does hereby direct the representatives of Management to affix their signatures thereon. The City Clerk shall certify the passage of this Resolution. APPROVED AND PASSED this 1st day of MAY 1995.
