A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
APPROVING AN AMENDMENT TO THE MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA
POLICE OFFICERS' ASSOCIATION AND AUTHORIZING THE
REPRESENTATIVES OF MANAGEMENT TO SIGN THE AMENDMENT
WHEREAS, a Memorandum of Understanding between the City Council of the City of
Azusa and the Azusa Police Officers'Association (APOA) was approved and passed on January 4,
1994, and
WHEREAS, the said Memorandum of Understanding covers the period July 1, 1993
through July 31, 1996, and
WHEREAS, Section 1 of the Memorandum of Understanding provides for re -openers, and
WHEREAS, representatives of Management and members of APOA met and conferred in
good faith on the matter of special retirement provisions for members of the Association who have
loyally and dutifully devoted their law enforcement careers towards public safety service with the
City of Azusa, and
WHEREAS, Management submitted a schedule showing longevity, accrued unused Sick
Leave balances and cash values of the Leave for all of the members of APOA, that indicated that
very few members of APOA had achieved as many as 20 or 25 years of public safety service to the
City of Azusa, and
WHEREAS, Members of APOA have the ability, upon retirement, to receive up to 50%
of their respective unused accumulated sick leave in cash, or to defer up to 50% of it to retirement
investments or towards reimbursement of medical expenses during retirement, or to convert up to
100% of it to retirement service credit, or a combination of these options, and
WHEREAS, Management and Members of APOA agree that enhancements to Sick Leave
cash -out provisions would be worthwhile incentives and rewards for the City's safety employees,
who, as a group, already have an excellent reputation for prudent use of leave,
NOW, THEREFORE, BE IT RESOLVED that:
1. Section 6.5. 10 of the MOU shall be deleted in its entirety.
2. Anew Section 6.5.10 shall be added to the MOU, to read as follows:
"6.5.10 Conversion to Cash Upon Separation.
"Upon separation due to death (if he or she had attained permanent status) the
employee's estate may receive fifty percent (50%) of his or her accrued Sick Leave
balance in cash.
"Upon disability retirement with at least five (5) years of service with the City of
Azusa, the employee may convert fifty percent (50010) of his or her accrued Sick
Leave balance to cash.
"Upon voluntary separation with less than ten (10) cumulative years of sworn safety
service with the City of Azusa Police Department, the employee may convert fifty
percent (50%) of his or her accrued Sick Leave balance to cash for hours in excess
of three -hundred twenty (320) hours to a maximum payment of two hundred forty
(240) hours.
"Upon voluntary retirement with at least ten (10) years of City service, the employee
may convert fifty percent (50%) of his or her accrued Sick Leave balance to cash.
"Upon voluntary separation with at least ten (10) cumulative years of sworn safety
service with the City of Azusa Police Department, the employee may convert fifty
percent (50%) of his or her accrued Sick Leave balance to cash.
"Upon voluntary separation with at least twenty-five (25) cumulative years of sworn
safety service with the City of Azusa Police Department, the employee may convert
one -hundred percent (100%) of his or her accrued Sick Leave balance to cash."
3. A new Section 6.5.11 shall be added to the MOU, to read as follows:
"6.5.11 Conversion to Service Credit Upon Retirement.
"Pursuant to the terms of the City's contract, as amended, with the Public Employees'
Retirement System, upon voluntary retirement the employee may convert 100% of
his or her accrued Sick Leave balance, less any amount converted to cash under the
provisions of Section 6.5.10, to retirement service credit."
4. The City Council does hereby approve the attached Amendment to the Memorandum
of Understanding and does hereby direct the representatives of Management to affix
their signatures thereon.
The City Clerk shall certify the passage of this Resolution.
APPROVED AND PASSED this 1st day of MAY 1995.

"Upon voluntary separation with at least twenty-five (25) cumulative years of sworn
safety service with the City of Azusa Police Department, the employee may convert one -
hundred percent (100%) of his or her accrued Sick Leave balance to cash."
