A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF AZUSA APPROVING A TIME EXTENSION
FOR CONDITIONAL USE PERMIT NO. C-415
WHEREAS, on December 1, 1986 the City Council approved a
conditional use permit applied for by Fred Peterson for the
expansion of a nonconforming automobile sales use on property
located at 324-350 West Foothill Boulevard (Conditional Use Permit
No. C-415), and
WHEREAS, this conditional use permit allowed certain
nonconforming residential uses on the property to remain until
November 17, 1991, and
WHEREAS, on December 2, 1991, the City Council adopted
Resolution No. 91-C177 extending the allowable timeframe for the
residential uses to November 17, 1996, and
WHEREAS, Mr. Peterson has now requested that this timeframe be
extended until January 6, 2003, and
WHEREAS, the Planning Commission considered this request in a
duly noticed public hearing on September 27, 1995, and, after
carefully considering all pertinent evidence and testimony,
recommended to the City Council that this request be denied, and
WHEREAS, Mr. Peterson has appealed the Planning Commission's
decision to the City Council, which held a duly noticed public
hearing on November 6, 1995, and
WHEREAS, the City Council of the City of Azusa carefully
considered all the pertinent evidence and testimony regarding the
extension of Conditional Use Permit No. C-415,
NOW THEREFORE, the City Council of the City of Azusa does hereby
resolve as follows:
SECTION 1. The City Council for the City of Azusa finds
that the granting of the time extension for the nonconforming
residential uses described in Conditional Use Permit No. C-415 is
justified as the following findings can be made in conformance with
Section 86-1602 (b) of the Azusa Municipal Code:
a) The maintenance of these smaller residential units which
have lower rents is in keeping with the goals and
objectives of the Housing Element of the Azusa General
Plan to conserve affordable housing in the city;
b) The housing units have been in existence for many years
without creating any conflicts with the surrounding
residents or properties. Their continued existence
should not create any changes to the neighborhood which
would affect nearby residents or property values or
create a menace to the public health or safety.
C) Although the existing dwelling units do not have the area
necessary to meet current standards for parking or
useable open space, they were developed in a manner
similar to many other nonconforming residences in the
city, which still provide adequate housing to meet the
needs of their inhabitants. The size and shape of the
lot will be able to continue to meet these needs for the
residents of the subject houses.

d) Both Foothill Boulevard and Sunset Avenue serve this
site, providing the residents and visitors to the
property with adequate circulation capacity to meet the
needs generated by this property.
SECTION 2. The City Council for the City of Azusa
therefore grants the requested time extension for the nonconforming
residential uses permitted under Conditional Use Permit No. C-415
until January 6, 2003 by amending Condition A of Section 2 of
Resolution No. 8147 to read as follows:
"Property owners shall terminate all residential uses on
the property on or before January 6, 2003 and such
residential uses shall not thereafter be permitted on the
property."
SECTION 3. The City Clerk shall certify to the adoption of
this resolution.
