RESOLUTION NO. 04-C48
A RESOLUTION OF THE UTILITY BOARD/CITY COUNCIL OF THE CITY OF
AZUSA ACCEPTING CERTAIN GRANT OF EASEMENT AND DIRECTING THE
RECORDING THEREOF.
THE UTILITY BOARD/CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTIONS 1. That certain Grant of Easement executed by State of California, Real Estate
Services Division, under date of the 10`h of June, 2004 to the CITY OF AZUSA a Municipal
Corporation in Los Angeles County, State of California, its successors and assigns, the right of
perpetual easement and right of way solely for the purpose of constructing, laying, maintaining,
operating, using, altering, repairing, replacing, inspecting and relocating therein and thereupon
and / or removing there from electrical utility lines and related facilities, with any and all
connections and devices necessary thereto for the transportation, distribution and /or supply of
electricity to the property, in, on, over, under across and along the following described real
properties situated in the CITY OF AZUSA, Los Angeles County, State of California, to wit:
See Exhibit "A" and "B" attached hereto each Grant of Easement
Said Grants of Easements are hereby accepted and the City Clerk is hereby authorized and
directed to cause the same to be filed for record in the office of the County Recorder of said
County.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution.

operate, use, repair, alter, replace -and remove electrical systems and communications systems
consisting of, but not limited to. overhead power lines, poles and fixirtres, guy wires, underground
conduits. pull boxes. transformers, pads, vaults, cables, conductors and other fixtures and appliances.
with the necessary appurtenances. for conveying electric energy to be used for light, heat. power and
for transmitting data by electrical means and/or other purposes ("Systems") over, under, in. along,
and across the following described parcel of real property situated in the City of Azusa. County of
Los Angeles, State of California:
As described in Exhibit "A" and depicted in Exhibit "B" attached
hereto and made a part hereof.
Together with all necessary and convenient means of ingress and egress to and from said right-of-
way or strip or parcel of land, free from any and all buildings, equipment, vegetation, combustible
materials. or obstructions of any kind, for the purpose of constructing. reconstructing, maintaining,
operating, repairing, renewing, replacing, using, altering, or removing in any manner the Systems
together with any and all of the purposes hereinbefore mentioned.
TO HAVE AND TO HOLD the above granted and described premises unto the CITY
OF AZUSA, CALIFORNIA. its successors and assigns forever.

A strip of land ten feet wide lying in Parcel 1 of Parcel Map No. 24852, in the City of
Azusa, County of Los Angeles, State of California, as per map filed in book 284, pages
91 through 95 inclusive of Parcel Maps in the office of the County Recorder of said
county, the centerline of said strip being more particularly described as follows:

Beginning at a found spike and washer stamped "LS6217" in the centerline of Sierra
Madre Avenue at the easterly end of that course having a bearing of N89°33'23"E and a
distance of 104.76 feet as shown on said Parcel Map; said course being the basis of
bearings for this description; thence, SO°26'37"E 42.00 feet to a point in the southerly
line of Sierra Madre Avenue; thence, S89°33'23"W along said southerly line 28.76 feet to
a point at the beginning of a tangent curve, concave northeasterly, having a radius of
74.00 feet; thence, northerly and westerly along said curve 100.34 feet through a central
angle of 77'41'31" to the True Point of Beginning, the radial bearing to said point from
the center of said curve being S77°14'43"W; thence, S87'41'43"W 89.67 feet; thence,
N89'48'34"W 282.80 feet; thence, N45°06'35"W 242.93 feet to a point designated as

RESOLUTION NO. -04-C47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
MAKING CERTAIN FINDINGS UNDER HEALTH AND SAFETY CODE
SECTION 33445 WITH RESPECT TO THE USE OF REDEVELOPMENT
AGENCY FUNDS FOR THE SIGNAGE IMPROVEMENTS TO THE
PROPERTY LOCATED AT 347 N. SAN GABRIEL BLVD
WHEREAS, the City of Azusa is pursuing grant funding for signage improvements on
the property located at 347 N. San Gabriel Blvd; and
WHEREAS, the City desires to replace and improve substandard signage to the property;
and
WHEREAS, the improvements to the signage include not only replacement costs but
related removal cost to the existing sign and archiving costs; and
WHEREAS, the Agency intends to use redevelopment funds to pay for signage
improvement costs; and
WHEREAS, the property is located near the Agency's Merged Redevelopment Project
Area; and
WHEREAS, with the consent of the City Council and subject to the Council's ability to
make certain findings more particularly hereinafter set forth, the Agency is authorized by Health
and Safety Code Section 33445 to use the redevelopment funds in the manner described in the
preceding recital.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Azusa as
follows:
Section 1. Based on the information made available in the staff report accompanying
this Resolution, the oral presentation of staff, and such other written and oral evidence as
presented to the City Council, the City Council hereby makes the following findings pursuant to
Health and Safety Code Section 33445 witl respect to the Agency's obligation to use
redevelopment funds for the signage improvement costs for the property located at 347 N. San
Gabriel:
1. That the project will be a benefit to the Agency's Merged Redevelopment Project
Area, because it will eliminate substandard conditions.
2. That there are no other reasonable means of financing the project, in that the
amount of financial resources available from the property owner for the Project are
limited and there are no federal or other public or private funds available to finance the
public improvements associated with the signage.

3. The Agency's payment of redevelopment funds for certain signage improvement
costs will assist in the elimination of substandard signage conditions within the Project
Area, in that it will provide a new sign to the business to encourage daytime and
nighttime dining for individuals in the Project Area, improve the aesthetic appearance of
the Project Area, and lead to greater pride of property ownership and maintenance
practices of the residents in the Project Area, which will likely increase property values in
and surrounding the Project Area.
Section 2. The Agency's payment of redevelopment funds for the new sign is
consistent with the Implementation Plan that the Agency has previously adopted for the Project
Area pursuant to Section 33490 of the California Health and Safety Code.
Section 3. The City Manager and the Executive Director is hereby authorized, with
the concurrence of the City Attorney, to take such further actions and execute such other
agreements as may be necessary or appropriate in administering the actions authorized by this
Resolution.
Section 4. This Resolution shall become effective upon its adoption.
