HomeMy WebLinkAboutResolution No. 04-C30i RESOLUTION NO. 04-C30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE 2004 CITY OF AZUSA GENERAL PLAN (GATEWAY TO THE AMERICAN DREAM), GENERAL PLAN MAP AND RELATED DOCUMENTS AZUSA GENERAL PLAN, GENERAL PLAN MAP AND RELATED DOCUMENTS WHEREAS, California Government Code, Section 65300 et seq. requires that each city adopt a comprehensive general plan to guide future growth and development; and WHEREAS, the City of Azusa's ("City") centennial in 1998 rekindled community concern about the City's next hundred years and launched an ambitious effort to gain opinion and participation of hundreds of residents from all backgrounds and walks of life to present a new vision for the City; and WHEREAS, these efforts led to the establishment of the Azusa Citizens Congress in May of 2000 where participants discussed and created statements of common values as the foundation for a new General Plan for the City and related documents, including the "Gateway to the American Dream' document, the Azusa General Plan document, the "Places and Changes" document and "Analysis and Trends" document (collectively the "General Plan"); and WHEREAS, the General Plan reflects the public participation and hard work of hundreds of Azusa residents and business owners who have actively participated in the work of the Citizen's Congress and the creation of the General Plan; and WHEREAS, in addition to the preparation of the General Plan, the City also directed the preparation of an Environmental Impact Report ("EIR") that discusses the potential environmental impacts of the General Plan in accordance with California Environmental Quality Act ("CEQA"), the state CEQA Guidelines and the City's Local Guidelines for implementing CEQA; and RVPUB\MXM\671087.1 WHEREAS, beginning on January 14, 2004, January 28, 2994, February 11, 2004, February 25, 2004, March 10, 2004, and ending on March 24, 2004, the Planning Commission of the City of Azusa ("Planning Commission") conducted duly noticed public hearings on the General Plan and EIR at which time all persons wishing to testify in connection with the General Plan were heard and the General Plan was fully studied, discussed and deliberated; and WHEREAS, the Planning Commission carefully considered all pertinent testimony and the staff reports presented during the public hearing for the General Plan and recommended adoption of the General Plan and certification of the General Plan EIR to the City Council at their meeting of March 24, 2004; and WHEREAS, the City Council of the City of Azusa ("City Council") conducted duly noticed public hearings and workshops on the General Plan and General Plan EIR on January 14, 2004, March 29, 2004, April 5, 2004, April 12, 2004, and April 19, 2004 at which time all persons wishing to testify in connection with the General Plan and EIR were heard and the General Plan and EIR were fully studied; discussed and deliberated; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: Based on the entire record before the City Council, all written and oral evidence presented to the City Council, and the findings made in the staff reports and this Resolution, the City Council of the City of Azusa hereby approves and adopts the General Plan and its related documents, as set forth in the attached Exhibit "A" to this Resolution. SECTION 2: Based on the entire record before the City Council and all written and oral evidence presented, including the staff reports and the recommendation of the Planning Commission, the City Council finds the General Plan promotes the goals and objectives of the City of Azusa and is a compatible, integrated, and internally consistent statement of policies for the following reasons: -2- RVPUMM M\671087.1 0 0 A. Pursuant to Government Code, Section 65300, the General Plan is comprehensive and long term. B. Pursuant to Government Code, Section 65300.5 and 65302, the General Plan and its elements and parts comprise an integrated, internally consistent statement of policies and addresses all issues required by state law. Further, the data, assumptions and projections are consistent with one another. Specifically, among other reasons,: Figure GEO-3.). Figure N-3.). 1. The General Plan identifies areas that are subject to flooding. ( See GP 2. The General Plan shows noise contours for specific sources. (See GP 3. The General Plan contains standards of population density and building intensity for the various land uses. (See GP Table CD -2, GP Figure CD -3; Trends Figure 2- 10 to 2-15.). 4. The General Plan's mobility element is fiscally responsible and correlated with the land use element. (See GP Mobility Element Policies; GP Mobility Policy 1.1.). 5. The General Plan specifies allowable uses in each land use district (See GP Table CD -2; General Plan Implementation Matrix.). 6. The General Plan provides density ranges that allow the making of consistency findings (See GP Table CD -2.). 7. The General Plan housing element complies with state law. (See GP Chapter 3 — Housing Element.). C. Pursuant to Government Code, Section 65302, the General Plan addresses all of the mandatory elements required by law including the Land Use, Housing and Circulation elements (Built Environment Component) and the Open Space, Conservation, Safety and Noise elements (Natural Environment Component), as well as other optional elements. SECTION 3: The City Council also finds that the General Plan is in the public interest because it provides for additional opportunities for the future growth and development of -3- RVPUBWXW71087.1 0 0 Azusa in an environmentally sensitive manner. SECTION 4: In considering this General Plan, the City Council has considered the housing needs of the region and balanced those needs against the public service needs of the residents and available fiscal and environmental resources. SECTION 5: The City Council also finds that the General Plan is consistent with the California Surface Mining and Reclamation Act (California Public Resources Code, Section 2715 et seq. — "SMARA") and advances state mining policies. Specifically, The policies contained in the "Natural Environment" Element of the Azusa General Plan, identified as the City's "Mineral Resource Management Policies" comply with SMARA for the following reasons: a. The policies recognize the mineral information provided by the state (See General Plan Figure MR -1); b. The policies assist in the management of land uses which are incompatible with the development of minerals in areas designated as having state or regional significance. (See Mineral Resource Policy MR3, See also Table CD -2, Land Use Goal No. 8 and Policies 8.1 to 8.12) The General Plan designates a majority of the available areas of regional significance in the "Open Space' land use designation which prohibits all but passive open space uses. Thus, there will be no uses permitted that are incompatible with mining operations. Further, the proposed Development Code will contain an "Open Space" zoning designation that will be consistent with the General Plan Land Use designation. C. The policies emphasize the conservation and development of identified mineral deposits (See Mineral Resource Figure MR -1 & MR -2; Mineral Resource Policies 1.2 & 1.3 which permit continued mining; See also Land Use Goal No. 8 and Policies 8.1 to 8.12.) Thus, in accordance with Public Resources Code, Section 2764, the City Council finds that the future land uses and particular access routes identified in the General Plan are compatible with the continuation of surface mining operations because the General Plan contains policies that recognize areas of regional significance and permit mining to continue within mining operations that have a vested right to mine in the City of Azusa. Moreover, the General Plan policies -4- RVPUBU4XM1671087.1 0 0 prohibit the development of uses that would be incompatible with such mining operations. The General Plan policies also prohibit development of uses that would be incompatible with mining operations in non -vested areas that have regional significance should these areas ever be considered for mining. SECTION 6. An Initial Study and EIR have been prepared for the General Plan in accordance with the provisions of CEQA, the State CEQA Guidelines, and the City of Azusa's procedures for implementing CEQA. The City Council, by adoption of Resolution No. - hereby adopts and certifies the approval and adoption of the EIR for the General Plan. SECTION 7: This resolution shall take effect thirty (30) days after its adoption. SECTION 8: The Secretary shall certify to the adoption of this resolution.
