HomeMy WebLinkAboutResolution No. 04-C810 0 RESOLUTION NO. 04-C81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AND ADOPTING A RELOCATION AND REPLACEMENT HOUSING PLAN IN CONJUNCTION WITH THE PROPOSED NEW CITY LIBRARY PROJECT WHEREAS, the City of Azusa, California ("City"), intends to develop a new municipal library facility ("Library Project") on certain real property within the City (the "Site"); and WHEREAS, the Library Project will result in the destruction and removal of dwelling units from the Site; and WHEREAS, the California Relocation Assistance Act (Government Code Sections 7260, e1 seq.) ("Act"), requires the City to provide certain relocation assistance and payments to persons who are displaced from dwelling units as a result of the Library Project; and WHEREAS, the Relocation Assistance and Real Property Acquisition Guidelines (Title 25 California Code of Regulations Sections 6000 et seq.) ("Guidelines") require the City to develop and adopt, by resolution, a relocation plan, prior to proceeding with any phase of a project that may result in the destruction or removal of dwelling units; and WHEREAS, pursuant to the Act and the Guidelines, the City has prepared a Relocation Plan relative to the proposed Library Project, which is attached to this Resolution as Exhibit A ("Relocation Plan"); and WHEREAS, the Relocation Plan was made available to the public, potential displacees and other public agencies, for review in accordance with Title 25 CCR Section 6038, as of August 27, 2004, no less than thirty (30) days prior to the timely and properly noticed public meeting at which this Resolution is considered by the City Council; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA RESOLVES AND DETERMINES, AS FOLLOWS: Section 1. On June 3, 2002 the City Council approved the Azusa Library Initial Study and Mitigated Negative Declaration (the "MND") in accordance with the provisions of the California Environmental Quality Act ("CEQA"), the State CEQA Guidelines, and the City's CEQA implementing procedures. The displacement and relocation of three (4) residential households and two (2) businesses was considered in the MND. Section 2. The City further finds and determines that there are no significant environmental effects or any differences in the severity of environmental effects associated with the contemplated Library Project from those assessed in the MND that would require additional environmental review, pursuant to California Public Resources Code Section 21060 or Title 14 California Code of Regulations Sections 15162 or 15163. 0 0 Section 3. The City Clerk is authorized and directed to file a Notice of Determination under CEQA with the Clerk of the Board of Supervisors of the County of Los Angeles, California, within five (5) days following the date of adoption of this Resolution. Section 4. The City Council received and reviewed the Relocation Plan in the form attached to this Resolution as Exhibit A and hereby approves and adopts the Relocation Plan for the Library Project. Section 5. The City Manager, or his designee, is hereby authorized to take all reasonable actions to implement and carry out the Relocation Plan for the Library Project and to execute any documents and take any other actions reasonably necessary or convenient for the proper accomplishment of the purposes of the Relocation Plan for the Library Project. Section 6. All persons and businesses displaced by the Library Project shall be eligible to receive relocation assistance and/or monetary compensation consistent with the Act and the Guidelines PASSED, Secretary This Resolution shall become effective immediately upon its adoption. this 4`h day of October, 2004.
