HomeMy WebLinkAboutResolution No. 96-C81N RESOLUTION NO. 96-C81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DENYING CONDITIONAL USE PERMIT NO. C-95-8 WHEREAS, an application was received from Seidner Development and Angel Juarez for a conditional use permit to allow on-site promotional events as an outdoor festival on property located at 975 West Foothill Boulevard (Conditional Use permit No. C-95-8), and WHEREAS, the Planning Commission considered this request in duly noticed public hearings on July 12, 1995, and February 14, 1996, and has carefully considered all pertinent evidence and testimony, and WHEREAS, the Planning Commission adopted Resolution No. 96-1 recommending to the City Council that this conditional use permit be approved, and WHEREAS, the City Council has held duly noticed public hearings on April 1, 1996, and April 22, 1996, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Conditional Use Permit No. C-95-8, NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows: SECTION 1. The proposed on-site promotional events will create impacts on surrounding commercial properties and possible public safety problems which are inconsistent with the goals and objectives for commercial development contained within the Land Use Element of the Azusa General Plan. SECTION 2. The noise and off-site parking which will be generated by these events will adversely effect the peace of persons residing or working in the surrounding area. Parking on other parcels would be materially detrimental to the current use of other properties in the area and would therefore have a negative effect on the valuation of these parcels. The increased pedestrian and vehicular traffic generated by this use would create conflicts with traffic on Foothill Boulevard, constituting a menace to the public safety. SECTION 3. The proposed use will utilize all available on- site parking for the operation of the promotional events. The substantial off-site parking generated by these events indicates that the proposed site is inadequate in size to accommodate the parking required to integrate the use with the uses in the surrounding area. SECTION 4. The proposed site is served by Foothill Boulevard, which has adequate capacity to carry the kind and quantity of traffic generated by the proposed use. SECTION 5. Conditional Use Permit No. C-95-1 is hereby denied. SECTION 5. The City Clerk shall certify to the adoption of this resolution.
