RESOLUTION NO. 96-C62
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA IN
SUPPORT OF THE PASSAGE OF SB 1628 "LAND USE AND SEXUALLY -
ORIENTED BUSINESSES"
WHEREAS, several sexually -oriented businesses, that do not sell alcohol but welcome the
patronage of 18 -year-old persons, known as "juice bars", have appeared in the San Gabriel Valley,
and
WHEREAS, this is a problem because nearby residents, businesses and churches did not
have the opportunity to provide their input before the "juice bars" were established, and
WHEREAS, the City of Industry, in which the "juice bars" are located, did not have a
content -neutral ordinance that provides a process for establishing proper zoning and public process
for such businesses, and
WHEREAS, residents were left unprotected because they had no viable option through
which to deal with the proximity of such sexually -oriented businesses to neighboring homes,
businesses and churches, and
WHEREAS, in California, no uniformity exists in dealing with sexually -oriented businesses,
and
WHEREAS, SB 1628, entitled, "Land Use and Sexually -oriented Businesses", would require
all cities and counties to adopt a Content -Neutral -Zoning Ordinance, and
WHEREAS, SB1628 would amend the Government Code to specify that if, in zoning
matters, the subject real property is a sexually -oriented business, notice shall be mailed to owners
of property located within 2000 feet of the subject real property, and
WHEREAS, SB 1628 would provide that local government has the responsibility to consider
secondary effects due to an establishment of a sexually -oriented business, and
WHEREAS, the City Council of the City of Azusa did, at its May 6 regular meeting, discuss
the importance, not only to the City of Azusa, but to all cities in California, of maintaining the rights
of individuals and property owners to attend and express their views regarding such sexually -
oriented businesses at duly organized public hearings held for that purpose, and
WHEREAS, the City Council of the City of Azusa did, by unanimous action at its May 6
meeting, vote to support California Senator Hilda Solis in calling for the passage of SB1628,
entitled, "Land Use and Sexually -oriented Businesses".
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa
does hereby unanimously support California Senator Hilda Solis in calling for the passage of
SB 1628, entitled "Land Use and Sexually -oriented Businesses".
