HomeMy WebLinkAboutResolution No. 96-C1090 RESOLUTION NO. 96—C109 0 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CONFIRMING THE ENGINEER'S REPORT DATED MAY 29, 1995 AND ORDERING THE LEVY AND COLLECTION OF A CITYWIDE FIRE SUPPRESSION BENEFIT ASSESSMENT ON THE UTILITY ROLL TO FUND FIRE SUPPRESSION SERVICES FOR FISCAL YEAR 1996-97 WHEREAS, the City Council of the City of Azusa, California ("the City Council"), did, on the 3rd day of June 1996, adopt Resolution of Intention No. 96 (the "Resolution of Intention") to levy an assessment within the City of Azusa a Fire Suppression Benefit Assessment District (the "Benefit Assessment") on the utility roll within the City to fund the payment to the Los Angeles County Fire Protection District for fire suppression services to the City and call for the preparation of a report pursuant to the Fire Suppression Benefit Assessment Law (Government Code Section 50078 et sea.0 (the "Act" and the "Report") by City staff; and WHEREAS, City staff and the engineering firm of Kenneth I. Mullen/Huitt Zollars have prepared the Report pursuant to the Act and have filed such Report with the City Clerk; and WHEREAS, the City Clerk noticed, in the time and manner provided in the Act, a protest hearing for this date and time on the issues of levying and collecting these assessments on the utility roll; and WHEREAS, at the time and place noticed the City Council duly conducted such protest hearing, and considering any and all written protests against the levy and collection of the assessments; and WHEREAS, valid protests are less than fifty percent of the total expected revenue from the assessments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Report attached and incorporated herein by this reference, as Exhibit "A", hereby is approved, confirmed and adopted (as modified); a copy of the Report shall remain on file with the City Clerk and is available for public inspection. Section 2. The public interest and convenience require that the Benefit Assessment be levied and collected for the Los Angeles County Fire Protection District for fire suppression services, as set out in the Report for the 1996-97 fiscal year and the City Council hereby orders that such assessments be as set forth and described in the Resolution of Intention. Section 3. The adoption of this resolution shall constitute a levy of the assessment as set forth in the Report for fiscal year 1996-97, with the amendment that the amount of the assessments shall remain the same as last year (FY 1995-96), contingent upon the execution of an agreement between the cities of Azusa and Torrance to exchange Preposition A funds for General Funds. Section 4. The City Clerk shall certify the adoption of this resolution. PASSED, APPROVED AND ADOPTED this 5thday of August , 1996.
