HomeMy WebLinkAboutResolution No. 96-C190*RESOLUTION NO. 96-C190 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OPPOSING THE SMOG CHECK II PROGRAM AND REQUESTING THE GOVERNOR AND STATE LEGISLATURE REPEAL THE SMOG CHECK II PROGRAM AND REIMPLEMENTATION OF THE PREVIOUS TEST THAT CONTINUES CLEANING THE AIR IN CALIFORNIA. WHEREAS, the current Smog Check Program implemented by the State in 1982, has a proven track record of effectively increasing cleaner air in California; and WHEREAS, each year older polluting cars are retired and newer lower polluting cars are taking their place; and WHEREAS, the failure rate of vehicles under the Smog Check II Program will cause a significant financial burden on most motorists in the Enhanced Areas; and WHEREAS, the cost of performing Smog Check II Dyno tests will more than triple over the current costs; and WHEREAS, with Smog Check II Dyno testing, most cars older than 1992 that have effective smog control equipment will be found not in compliance; and WHEREAS, under Smog Check II gross polluters will have to be repaired at an unlimited cost to the owner or be removed from service within 30 days and failure to comply will result in the owner having to pay an administrative fee of $500; and WHEREAS, Smog Check II will force people to sell their vehicles to the test -only centers because local ordinances prohibit the storing of unregistered vehicles in residential yards and a gross polluter cannot be sold or transferred in California; and WHEREAS, with the pollution credit system, there will be no significant pollution reduction resulting from destroying Gross Polluters. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY FIND AS FOLLOWS: Section 1. The City Council of the City of Azusa hereby requests the Governor and the State Legislature repeal the Smog Check II Program and recommend reimplementation of the previous test that continues cleaning the air in California. Section 2. Copies of Resolution 96-6190 shall be forwarded to Governor Pete Wilson, all Senators and members of the Assembly, all City Councils in the Enhanced Areas, the League of California Cities, the California Contract Cities Association, and Professional Legislative Representatives Joe and Anthony Gonsalves. Section 3. The Mayor, or presiding officer, is hereby authorized to affix his signature to this resolution signifying its adoption by the City Council of the City of Azusa, and the City Clerk , of duly appointed deputy, is directed to attest there thereto. PASSED, APPROVED AND ADOPTED THIS 2nd day of December, 1996 I HEREBY CERTIFY that the foregoing Resolution No. 96-C199/as duly adopted by the City Council of the City of Azusa, at a regular meeting thereof, held on the 2nd day of December, 1996 by the following vote of the Council.
