HomeMy WebLinkAboutResolution No. 96-C168RESOLUTION NO.96-C168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING VARIANCE NO. V-96-8 WHEREAS, an application was received from Eugene Moses, Ray L. Corcoran and General Development Incorporated for a variance to allow reduced setbacks for future patio covers and balconies on property located at 1755 North San Gabriel Canyon Road (Variance No. V-96-8), and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on August 28, 1996, and has carefully considered all pertinent evidence and testimony, and WHEREAS, the Planning Commission adopted Resolution No. 96-28 recommending to the City Council that this variance be approved, and WHEREAS, the City Council has held a duly noticed public hearing on October 7, 1996, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Variance No. V-96-8. NOW THEREFORE, the City Council of the City of Azusa does hereby resolve as follows: SECTION 1. The City Council for the City of Azusa finds that the strict application of the zoning of the site would impose practical difficulties or unnecessary hardships on the site because most single-family residential homeowners have the opportunity to construct a patio cover on the rear of their home to add to the utility and enjoyment of their house. Due to the overall setback requirements of this project as a detached condominium site, some of the future property owners within this project would be unable to utilize this same opportunity, as the patio covers would encroach into the required setbacks. An unnecessary hardship would therefore be placed upon these homeowners by keeping them from having the same use of their property as other homeowners in Azusa. SECTION 2. The City Council for the City of Azusa finds that the location of this property between San Gabriel Canyon Road and the recharge basins creates a shallow site in which to design a single-family residential project. Combined with the overall setbacks for this project, which do not pertain to other traditional single-family housing projects in the city, this location creates an exceptional circumstance which is not generally found on other development sites in Azusa. SECTION 3. The City Council for the City of Azusa finds that the perimeter of this site adjoins a church, the recharge basins, San Gabriel Canyon Road and the Mirador project. Future patio cover construction would have minimal visual impacts on the first three of these neighboring uses, and the Mirador project has been approved for a similar patio cover variance. The requested setback variance would therefore not likely create any negative impacts on the value of surrounding properties. SECTION 4. The City Council for the City of Azusa finds that the proposed project is consistent with the objectives of the Land Use Element of the Azusa General Plan to "provide an orderly, functional and compatible land use pattern" in the area. The addition of patio covers to the rear of these homes would not alter the medium density residential character of this project. Page 1 of 2 0 RESOLUTION NO. 96-C168 PAGE 2 OF 2 0 SECTION 5. That based on the above findings, the City Council grants that Variance Case No. V-96-8 be approved for the property located at: 1755 NORTH SAN GABRIEL CANYON ROAD, subject to the conditions of approval listed in the attached Exhibit 'A'. SECTION 6. The City Clerk shall certify to the adoption of this resolution. ADOPTED AND APPROVED this 21st day of October STEPHEN J. ALEXANDER, MAYOR . 1996.
