RESOLUTION NO. 97—C175
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA APPROVING THE DECLARATION OF
RESTRICTIONS BY AND BETWEEN THE CITY OF AZUSA
AND TOTTEN PROPERTIES, LLC.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Azusa ("City") hereby finds, determines and
declares that:
A. The City is the owner of the property commonly known as 809 N. Angeleno Avenue
("City Yard"); and
B. Totten Properties, LLC, ("Totten") is the owner of the property commonly known
as 500 Danlee Street; and
C. Totten desires and agrees to rehabilitate their property at 500 Danlee Street; and
D. The Planning Commission of the City of Azusa approved the Precise Plan of Design
for the rehabilitation work on May 14, 1996; and
E. In order to further the rehabilitation of the 500 Danlee Street building and enclose the
structure, Totten must meet certain Building and Fire Code requirements; and
F. In order to satisfy the Building and Fire Code, the City may grant an easement
affecting the westerly 60 feet of the City Yard property to Totten; and
G. The City utilizes the westerly 60 feet of the City Yard property for outdoor storage
of materials and equipment; and
H. The City has no desire to construct building improvements on the westerly 60 feet
of the City Yard property; and
I. The City and Totten Properties have negotiated the terms of the Declaration of
Restrictions ("Declaration") ; and
J. The proposed Declaration contains all the provisions, terms, conditions, and
obligations required by local law; and
K. In consideration of the Declaration, Totten agrees to approve the Lot Line
Adjustment, which grants the City an additional 507.75 square feet and pay for one-half the cost to
construct a 50 -foot long concrete block wall; and
L. The rehabilitation of the 500 Danlee property and Declaration are in the best interests
of the City and in accord with the public purposes and provisions of applicable State and local laws.
SECTION 2. The City hereby finds and determined that the Declaration will assist in the
rehabilitation of the 500 Danlee property.
SECTION 3. The Mayor is hereby authorized to execute said Declaration on behalf of the
City and to take all action necessary to carry out said Declaration.
SECTION 4. The City Clerk shall certify to the passage and adoption of this Resolution and
the same shall thereupon take effect and be in force.
PASSED, 4PPROYED AND APOTED this 15th day of December 1997.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council
of the City of Azusa, at a regular meeting thereof, held on the 15th day of December
1997, by the following vote of the Council:
