HomeMy WebLinkAboutResolution No. 99-C0160 0 RE SOLUTION NO. 99—C16 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ADOPTING INFORMAL BIDDING PROCEDURES UNDER THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT (PUBLIC CONTRACT CODE SECTION 22000 ET aQ.) WHEREAS on January 19, 1999 the City Council of the City of Azusa, California, elected under Public Contract Code Section 22030 to become subject to the requirements of the Uniform Public Construction Cost Accounting Act ("Act"); WHEREAS, the City Clerk duly notified the State Controller of the election; and WHEREAS, the City Council now must adopt informal bidding procedures to implement the requirements of the Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, DOES FIND AND DECLARE THAT: SECTION 1: Informal Bid Procedures. Public projects, as defined by the Act, of seventy-five thousand dollars ($75,000) or less may be let to contract by the informal procedures set forth in Public Contract Code Section 22030 et seq. As indicated in Section 22032, public projects of twenty-five thousand dollars ($25,000) or less may be performed by negotiated contract or purchase order. SECTION 2: Contractors List. A list of contractors shall be developed and maintained in accordance with the provisions of Public Contract Code Section 22034 and any criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission ("Commission'). SECTION 3: Notice Inviting Informal Bids. Where a public project is to be performed which is subject to the informal bidding procedures of the Act, a notice inviting informal bids shall be mailed Pursuant to Public Contract Code Section 22034 to all contractors for the category of work to be bid, as shown on the list developed in accordance with Section 22034, and to all construction trade journals as specified by the Commission in accordance with Public Contract Code Section 22036. Additional contractors and/or construction trade journals maybe notified at the discretion of the City Manager; provided, however: (1) if there is no list of qualified contractors maintained for the County of Los Angeles for the particular category of work to be performed, the notice inviting bids shall be sent only to the construction trade journals specified by the Commission; and (2) if the product or service is proprietary in nature such that it can be obtained only from a RVPUMNGS\56121 0 0 certain contractor or contractors, the notice inviting informal bids may be sent exclusively to such contractor or contractors. SECTION 4. Award of Contracts. The City Manager is authorized to to take any actions necessary in an emergency pursuant to Public Contract Code Sections 22035 and 22050(a)(1). The City Council shall award all contracts. SECTION 5: Effective Date, This Resolution shall become effective upon its adoption.
