HomeMy WebLinkAboutResolution No. 99-C0700 0 RESOLUTION NO. 99-C70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING GENERAL PLAN AMENDMENT NO. GPA -994 AMENDING THE CITY OF AZUSA GENERAL PLAN LAND USE ELEMENT MAP TO RECLASSIFY PROPERTY LOCATED AT: 975 NORTH TODD AVENUE & 1301 WEST FOOTHILL BOULEVARD FROM ffi (HEAVY INDUSTRIAL) TO LI (LIGHT INDUSTRIAL) WHEREAS, the Planning Commission for the City of Azusa held a duly noticed public hearing on May 26, 1999, and, after fully considering all oral and written testimony offered at the aforementioned public hearing, adopted Resolution No. 99-18, recommending to the City Council the adoption of this resolution, and WHEREAS, the City Council of the City of Azusa held a duly noticed public hearing on June 7, 1999, concerning this general plan amendment and fully and carefully considered all oral and written testimony offered therein prior to acting on this resolution. THE CITY COUNCIL OF THE CITY OF AZUSA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The City Council of the City of Azusa determines and declares the following Findings of Fact: A. The proposed amendment is in the public interest, and there will be a community benefit resulting from the amendment. The project has been identified by the Redevelopment Agency as a product that is in demand in the industrial sector which will bring in more business into the community and, therefore, benefit the public at -large. B. The proposed general plan amendment is consistent with the other goals, policies, and objectives in the general plan. The amendment has been evaluated against the other elements of the Azusa General Plan and has been found to be consistent with these elements. The amendment will change the land use designation of one site and a portion of another site to a less intense but similar use designation. Although the proposed LI designation is considered "light" industrial which allows uses with less overall impacts than the existing heavy HI designation, it is nevertheless industrial. Therefore, the objectives of the industrial designations of the General Plan will remain consistent. C. The proposed general plan amendment will not conflict with provisions of the zoning ordinance, subdivision regulations, or any applicable specific plan. A zone change and tentative parcel map applications have been submitted with this request and are being considered simultaneously. D. This amendment to the Land Use Policy Map will not adversely affect surrounding properties. Surrounding properties are all designated industrial - HI to the north, west, and south and SP-1(HI) to the east and, therefore, share similar characteristics with the proposed development. E. This general plan amendment would not result in any immediate significant impacts on surrounding properties. The proposed general plan amendment would be reflective of existing uses in this area of the City. Any specific industrial activity on these properties would be subject to review and approval by a City Official, Planning Commission, and/or City Council since the buildings are proposed as speculative. Potential impacts under the proposed general plan designation would be less than that which might occur under the existing general plan designation due to the lighter designation. The amendment to the General Plan of Azusa as set forth in this resolution is consistent with the public necessity, convenience, general welfare, and good planning practice and is necessary for the preservation of the public health, safety and general welfare. SECTION 2. Pursuant to the City of Azusa CEQA implementing procedures and the State of California's CEQA guidelines, a Negative Declaration has been prepared, noticed, and reviewed, finding that the proposed project will not have a significant impact on the environment. The change in the Land Use Designation will reduce the intensity of potential uses on the properties. The project will reduce the types uses permitted on the property from heavy industrial uses to light industrial uses. The reduction in uses will reduce potential impacts to the environment at the same time. The City Council hereby certifies said Negative Declaration. SECTION 3. The City Council hereby approves the amendment of the Land Use Element Map of the General Plan of the City of Azusa to reflect the change in general plan land use designation for the properties located at 975 North Todd Avenue (6 of 11 parcels) and 1301 West Foothill Boulevard from HI to LI, as shown in Exhibit "A" attached to this resolution based on the aforementioned findings and conditions of approval listed as Attachment 3. SECTION 4. The City Clerk shall certify to the passage of this resolution and shall cause the same to be published in compliance with Chapter 88, Article III, Division 6 of the Azusa Municipal Code.
