HomeMy WebLinkAboutResolution No. 00-C0280 0 RESOLUTION NO. 00-C28 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING PRECISE PLAN OF DESIGN P-2000-22 FOR PHASE I OF SPECIFIC PLAN 5 CONSISTING OF A SOFTBALL FIELD AND A PARKING LOT AT 575 - 647 E. FOOTHILL BOULEVARD. WHEREAS, an application was received from Azusa Pacific University with respect to the requested Precise Plan of Design No. P-2000-22 to construct a softball field, informal grass athletic field, and a parking lot for approximately 520 cars at 575 - 674 E. Foothill Boulevard. WHEREAS, required notice was mailed as set forth in affidavits on file at the Community Development Department not less than ten days prior to the date of the hearing in compliance with City Code Section 88-125, 88-130, 88-135, and 88-140, and Government Code section 65090 and 95091. WHEREAS, the City prepared the Initial Study and Mitigated Negative Declaration in accordance with CEQA, the State CEQA Guidelines, and the City's CEQA implementing procedures, and that the City Council has reviewed and considered the Mitigated Negative Declaration and the comments received thereon. WHEREAS, the City Council of the City of Azusa has carefully considered all the pertinent evidence and testimony regarding Precise Plan of Design No. P-2000-22 THE CITY COUNCIL OF THE CITY AZUSA HEREBY RESOLVES AS FOLLOWS: SECTION 1: That Precise Plan of Design No. P-2000-22 would not substantially depreciate property values in the vicinity. SECTION 2: That Precise Plan of Design No. P-2000-22 would not unreasonably interfere with the use or enjoyment of the property in the vicinity by occupants thereof for lawful purposes. SECTION 3: That Precise Plan of Design No. P-2000-22 would not adversely affect the public peace, health, safety or general welfare to a degree grater than that generally permitted by Chapter 86 of the Municipal Code. SECTION 4: Based on the aforementioned findings, the City Council does hereby approve the Precise Plan of Design No. P-2000-22 for the property located at 575 - 647 East Foothill Boulevard. subject to the conditions of approval attached hereto as Exhibit A, and incorporated herein by reference, as though set out in full and at length. SECTION 5: Pursuant to the State CEQA guidelines, a mitigated negative declaration has been prepared and reviewed, finding that the proposed project could not have a significant effect on the environment. SECTION 6: The City Clerk shall certify to the passage of this resolution and shall cause the same to be published in compliance with Chapter 66, Article IV, Division 4 of the Azusa Municipal Code. Address: 575 - 647 East Foothill Boulevard A.P.N.: 8608-030-906, & 907 Project: Precise Plan of Design (P-2000-22) for Phase I of Specific Plan -5 (SP -5) which includes the development of an 11.83 acre site with a softball field, informal recreation area and surface parking for 520 cars. These conditions of approval shall be printed on or attached to working drawings submitted to the Building Division for approval. A. All requirements of the Engineering Division shall be met, including but not limited to the following: 1. The Applicant shall dedicate land for street purposes to accommodate the installation of new traffic signals at the intersection of Cerritos Avenue and Foothill Boulevard. Deed shall be executed before a Notary Public and delivered to the City Engineer prior to issuance of building permits. 2. The Applicant shall construct curb and gutter. 3. The Applicant shall construct sidewalks. 4. The Applicant shall construct driveway aprons. 5. The Applicant shall provide street lights on marbellite standards. 6. The Applicant shall provide wheelchair access ramps. 7. An on-site drainage plan shall be prepared and submitted to the City Engineer for approval at the time of building plan check submittal. Plan shall be 24" x 36", ink on mylar. Plan shall be prepared by a registered civil engineer. Grading plan check fees must be paid in advance. 8. Grading shall be performed per County of Los Angeles Uniform Building Laws, current edition, relating to Excavations and Fills. 9. The Applicant shall design and construct V.C.P. sewer. 10. Connect to a public sewer w/a V.C.P. sewer connection. 11. Paving to join existing pavement or to centerline shall be provided for those portions of the street where off-site work is required. 12. Improvement plans prepared by a registered Civil Engineer shall be submitted for all off-site (public works) improvements. Plan check fees shall be paid in advance. Plans shall be 24" by 36" ink on mylar. 13. A City Construction Permit shall be obtained for all work undertaken in the public right-of- way. All work shall be done in accordance with City of Azusa Standards and Standard Specifications for Public Works Construction (Green Book), latest edition and to the satisfaction of the City Engineer or his designee and shall be completed before issuance of Certificate of Occupancy. 14. A bond or security device shall be posted with the City in an amount sufficient to cover the amount of off-site work to be done. as determined by the City Engineer. No Building Permit will be issued until this device is posted. 15. The contractor shall take every step necessary to contain all dirt, construction materials, and construction run-off on site. No grading or construction -related debris, either directly or indirectly carried by water, will be permitted to leave the construction site. 16. Grading and construction activities in areas over five (5) acres require a Construction Permit from the State of California Department of Regional Water Quality Board. 17. The recently adopted SUSUMPS by the RWQB -may- apply to this project. 18. The sewer capacity of the existing system needs to be analyzed. B. All requirements of the Planning Division shall be met, including but not limited to the following: THE FOLLOWING CONDITIONS SHALL BE SATISFIED BEFORE ANY BUILDING Page 1 of 4 Exhibit "A" PERMITS MAY BE ISSUED: 1. The approval hereby granted is conditional upon the privileges being utilized within six (6) months after the effective date thereof and if they are not utilized or construction work is not begun within said time and carried on diligently in accordance with conditions imposed, this approval shall become void and any permission or privilege granted hereby shall be deemed to have elapsed. 2. All necessary permits shall be obtained. 3. All applicable Building Department and Fire Department requirements shall be met at all times. 4. The main Foothill Boulevard vehicular entry to the site should be modified to include additional enhancements including, but not limited to decorative pavers, landscaped median islands, fountain(s) and/or public art, to provide a prominent entry statement. 5. Prior to submitting for Building Department plan check, applicant shall submit a revised plot plan and elevations subject to the review and approval by the Community Development Director. The revised plan shall show the precise location and dimensions of all uses and structures including the proposed locker room facilities, fences, parking areas, lighting and landscaping. Thereafter, all construction and uses shall be in conformance with the revised plot plan. 6. Permeable asphalt should be used for the approximately one acre portion of the site adjacent to Foothill Boulevard. 7. The amplified public address system proposed for the baseball field shall be operated at a volume level no higher than that necessary to be audible above the background noise level. Azusa Pacific University shall post signage, highly visible to adjacent residences, which includes a telephone number to call to voice any complaints or concerns regarding noise from the project site. 8. The design of all high-intensity light standards associated with the softball field shall be subject to best practices. All such lighting shall be fitted with visor and glare control devices such that all light is focused on the fields and glare and light spillover onto adjacent properties is minimized to the greatest extent feasible. Spillover and glare shall be routinely monitored by Azusa Pacific University and any necessary adjustment and/or repairs shall be made to ensure that spillover and glare are maintained at levels specified in the project lighting plan (to be submitted by the manufacturer prior to project approval). Azusa Pacific University shall post signage, highly visible to adjacent residences, which includes a telephone number to call to voice any complaints or concerns regarding light and glare from the proposed project. 9. Landscaping shall be adequately maintained at all times including, but not limited to, irrigation, weeding, and/or replacement when necessary. 10. Three sets of landscape and irrigation plans shall be submitted to the Planning Division for review and approval of location and percentage of coverage. Said plans shall be 24" by 36" and in compliance with City of Azusa landscape design standards. Plans will be routed by the Planning Division to the Public Works Department for approval of planting material, irrigation, and soil amendment plan. 11. All mechanical equipment shall be screened to the satisfaction of the Planning Division. 12. Final design of elevations with respect to architectural detail, color, and other design enhancements shall be worked out to the satisfaction of the Community Development Director. 13. In the event that construction activities cause a disruption to pedestrian access along City sidewalks adjacent to the site, the applicant shall be responsible for providing crossing guards adjacent to the site during normal school hours to provide for safe pedestrian circulation. 14. The applicant shall be responsible for posting and thereafter maintaining signs along 8th Street between the east and west driveway entrances to Azusa Gardens Apartments (at least two signs on each side of the street) requesting that motorists visiting the University's athletic facilities use the University s off-street surface parking lot. 15. All standards pursuant to the Specific Plan, including amendments set forth in these conditions, shall be complied with. C. All requirements of the Building Division shall be met, including but not limited to the Page 2 of 4 Exhibit "A" 0 following: 1. Applicant shall conform to the 1998 Uniform Building Code incorporating the 1997 Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code and the 1996 National Electrical Code, and all applicable Azusa Municipal Ordinances. 2. All plan check fees shall be paid at the time of plan check submittal. Once plan check is completed and approved, applicant shall be responsible to pay in full all other appropriate development fees (i.e. school district fees, water reimbursement, park fees) prior to issuance of any building permit. 3. Electrical, mechanical, plumbing plan check fees are required. 4. Applicant shall submit 4 copies of foundation, framing, floor and elevation plans for plan check. 5. Structural, architectural, electrical, mechanical, plumbing plans shall be designed by a State of California Registered Engineer, or a State of California Registered Architect. 6. Applicant shall submit 4 copies of structural calculations simultaneous with the construction plans. 7. Electrical, mechanical, plumbing plans shall be submitted for plan check simultaneous with the construction plans. 8. Applicant shall submit 2 copies of soil report simultaneous with the construction plans. 9. Property shall be surveyed by a State of California Licensed Surveyor and the report shall be submitted simultaneous with the construction plans. 10. Prior to issuance of a permit, the applicant shall submit approval from the Los Angeles County Health Department, the Los Angeles County Fire Department. Applicant shall comply with all applicable construction related air quality control measures as required by the SCAQMD (Southern California Air Quality Management District) 11. Applicant recognizes that approval granted is for planning and zoning only and the owner is obligated to meet all applicable Building Division requirements. 12. Applicant is advised that the Building Division has handouts available at front counter that deal with new Commercial Buildings new single-family dwellings tenant improvements residential room additions. In order to complete your proposed project in a timely manner, please pick up a copy that deals with your particular project. 13. Property falls within a area of potential earthquake induced Liquefaction, Landslides orboth. A site-specific Geologic investigation must be conducted for the property. The site investigation report must be prepared by a certified engineering geologist or registered civil engineer who must have competence in the field of seismic hazard evaluation and mitigation. The geologic report must be submitted to the Department of Community Development for review. Plan review fee's will be based on actual costs with a minimum deposit of $ 1000.00 due when the report is submitted. 14. Plans as submitted are not acceptable for Building Division submittal. D. That all conditions of the Water Department shall be met, including but not limited to the following: 1. This complex to be master metered from one meter. 2. More than one meter can be used on approval of the water Operations manager. 3. Will require approved backflow devices. 4. The installation of a new water main will be subject to the approval of the Water Division. 5. Plan check is required. 6. This project is subject to Ordinance 96-08, Chapter 78-471, City of Azusa Municipal Code entitled "Water System Development Fee". Fee must be paid to the Light and Water Department before a Building Permit will be issued. 7. This project may require fire flow availability information before the L.A. County Fire Department will approve a building permit. E. That all conditions of the Light Department shall be met, including but not limited to the following: Overhead Power Lines. Existing facilities and easements shall be retained within the project Page 3 of 4 Exhibit "A" 0 0 site, until such time that a replacement underground electric distribution system is constructed. Removal of existing electric facilities affected by proposed project shall be arranged with Azusa Light & Water Department prior to starting any improvements. 2. New Electric Services. Subject to the provisions in the DDA, Owner/project developer shall install underground electric facilities necessary to provide electric services at new athletic fields and buildings. Owner is required to furnish and install underground facilities which include but not limited to conduits, pull boxes, vaults, roadway lighting, secondary service cables and pedestals for metering. s. Electric utility fees or charges as per Azusa Utility Rules and Regulations shall be paid by owner / project developer. These may include but not limited to material, labor & equipment charges for high voltage cables, deposits on transformer equipments, meter pre -payments etc. 4. Underground Electric Easements. Upon completion, owner shall grant an easement to Azusa Light & Water Department for all underground electric facilities installed within project site. Owner to prepare easement documentation and forward duly executed document to City for acceptance. 5. Detailed utility service requirements to be determined when actual plans of the athletic field and buildings are forwarded to Azusa Light & Water Department for review. Owner/developer to submit plans showing the following: a. Site survey, plan of building improvements. b. Electric service desired, load, and one -line diagram. C. Preferred locations for transformers, meters and related structures. F. That all conditions of the Fire Department shall be met, including but not limited to the following: I.
