HomeMy WebLinkAboutResolution No. 00-C027RESOLUTION NO. 00—C27 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE AMENDMENT TO THE LAND USE ELEMENT FROM COMMUNITY COMMERCIAL (CC) TO SPECIFIC PLAN (SP) OF THE AZUSA GENERAL PLAN IN CONNECTION WITH ZONE CHANGE NO. Z-2000-01 WHEREAS, required notice was mailed as set forth in affidavits on file at the Community Development Department not less than ten days prior to the date of the hearing in compliance with City Code Section 88-125, 88-130, 88-135, and 88-140, and Government Code section 65090 and 95091. WHEREAS, the City prepared the Initial Study and Mitigated Negative Declaration in accordance with CEQA, the State CEQA Guidelines, and the City's CEQA implementing procedures, and that the City Council has reviewed and considered the Mitigated Negative Declaration and the comments received thereon. WHEREAS, the Applicant sponsored and conducted a community meeting on February 8, 2000, to solicit input regarding the Project Approvals and to disseminate information regarding the same. WHEREAS, the City published a notice of its intention to adopt the Mitigated Negative Declaration in compliance with Public Resources Code section 21092 in the San Gabriel Valley Tribune on February 10, 2000, which notice also included a notice of the public hearing before the Planning Commission on March 1, 2000. WHEREAS, the City mailed notice of its intention to adopt the Mitigated Negative Declaration in compliance with Public Resources Code section 21092 on February 10, 2000, to the contiguous landowners and to all public entities entitled to notice under CEQA, which notice also included a notice of the public hearing before the Planning Commission on March 1, 2000. WHEREAS, the Planning Commission held a duly noticed public hearing on March 1, 2000, on the Initial Study and Mitigated Negative Declaration and on the Project Approvals, during which hearing testimony was received from nine residents living near the Project site in favor of the proposed Project; and written comments and testimony from two resident against the Initial Study and Mitigated Negative Declaration was submitted. WHEREAS, after receiving the aforementioned written comments and testimony, the Planning Commission closed the public hearing on March 1, 2000, and deliberated regarding the Initial Study and Mitigated Negative Declaration and the Project Approvals, and duly considered all information presented to it. WHEREAS, after due deliberation and consideration of the Initial Study and Mitigated Negative Declaration and the written and oral comments received, the Planning Commission voted unanimously to recommend that the City Council adopt the Mitigated Negative Declaration, and further recommended that the City Council approve the Project Approvals. WHEREAS, the City again published a notice of its intention to adopt the Mitigated Negative Declaration in the San Gabriel Valley Tribune on February 24, 2000, which notice also included a notice of the public hearing before the City Council on March 6, 2000. WHEREAS, the City again mailed a notice of its intention to adopt the Mitigated Negative Declaration to the contiguous landowners and to all public entities entitled to notice under CEQA, which notice also included a notice of the public hearing before the City Council on March 6, 2000. WHEREAS, the members of the City Council have been provided with copies of the Initial Study and Mitigated Negative Declaration and the comments received and have fully read the documents and comments thereon as well as the other information in the record of proceedings. WHEREAS, the Planning Commission's proceedings for a general plan amendment were in compliance with City Code Sections 88-275, 88-280. RESOLUTION NO. 0 02 7 • GENERAL PLAN AMENDMENT NO. GPA -2000-01 PAGE 2 THE CITY COUNCIL OF THE CITY AZUSA HEREBY RESOLVES AS FOLLOWS: SECTION 1: The land use designation contained within the Land Use Element of the Azusa General Plan is hereby changed from Community Commercial (CC) to Specific Plan (SP) for the properties located at 574 - 647 E. Foothill Boulevard as shown on Exhibit A. SECTION 2: That in accordance with Section 88-585 of the Azusa Municipal Code, it is found that the project would not unreasonably interfere with the use or enjoyment of property in the vicinity, and would not adversely affect the public peace, health, safety or general welfare, and provided the conditions of approval are adhered to, the City Council finds that: A. That the proposed amendment is in the public interest, and that there will be a community benefit resulting from the amendment: The Subject Property is an 11.83 acre vacant C3 zoned site surrounded by a drive-in theater, apartments, a church and miscellaneous commercial uses. The property previously developed with a blighted strip retail center set behind surface parking. The Specifac Plan will accommodate a variety of university related commercial, residential, educational, and athletic uses. The Specific Plan will promote traditional design concepts including tree lined streets and low scale buildings facing onto Foothill Boulevard which are consistent with the desired small town character of the City. The development of the site pursuant to the standards and guidelines of the Specific plan will help to solidify this segment of the Foothill Boulevard corridor. B. That the proposed amendment is consistent with the goals, policies, and objectives of the General Plan: Land Use Element Primary Community -Wide Land Use Goal: Provide for an orderly pattern of f eture development and change throughout the City that will both be compatible with and beneficial to existing land uses and which will ensure residents of a desirable urban environment in which to live, work, shop and play. The proposed Specific Plan contains standards and guidelines that will lead to the orderly development of the site in a manner that will be compatible with the surrounding land uses. Circulation Element Objective: To develop a balanced system of circulation which incorporates motor vehicles, pedestrians, bicycles and other private and public transportation modes with greater safety and increased energy efficiency. The proposed Specific Plan promotes the use of alternative modes of transportation by: creating a safe pedestrian environment with wide sidewalks and tree lined streets; providing a mix of land uses within easy walking distance; and limiting the amount ofparking to that which is necessary to serve the intended uses. Community Design Element Goals: 1. Provide guidelines for design treatments ofpublic and private buildings which are aesthetic yet economically practical. 2. Promote community identity through the upgrading of existing landscaping, redesign of existing buildings and design treatments for new buildings which are in keeping with community character. The proposed Specific Plan contains design guidelines and standards that provide for the orderly development of the site. The Plan promotes design concepts that recall the San Gabriel foothill area's history and small town character of tree lined streets with low scale buildings facing onto the streets. C. That the proposed amendment will not conflict with the provisions of the Zoning Code, subdivision regulations, or any applicable specific plan. RESOLUTION NO. 00-A • GENERAL PLAN AMENDMENT NO. GPA -2000-01 PAGE The proposal meets all of the applicable provisions of the Zoning Code for the proposed Specific plan (SP) zoning designation. In addition, all applicable city divisions and departments have reviewed the proposal and issued conditions for approval. D. That the proposed amendment will not adversely affect surrounding properties. A Mitigated Negative Declaration has been prepared for this project. The proposed mitigation measures serve to prevent adverse impacts on adjacent streets and highways, and neighboring residential uses. SECTION 3: Pursuant to State CEQA guidelines, a Mitigated Negative Declaration, has been prepared and reviewed, finding that the proposed project could not have a significant effect on the environment. SECTION 4: The Clerk shall certify to the adoption of this resolution and shall cause the same to be published in compliance with Chapter 88, Article III, Division 6 of the Azusa Municipal Code.
