HomeMy WebLinkAboutResolution No. 01-C0440 RESOLUTION NO. 01-C44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DETERMINING THAT A PROJECT AREA COMMITTEE SHALL NOT BE FORMED IN CONNECTION WITH THE PROPOSED AMENDMENTS TO THE REDEVELOPMENT PLANS FOR THE MERGED CENTRAL BUSINESS DISTRICT AND WEST END REDEVELOPMENT PROJECTS WHEREAS, by appropriate amendment to their respective redevelopment plans, the Central Business District and the West End Redevelopment Projects have been merged pursuant to Section 33485 et. seq. of the Health and Safety Code; and WHEREAS, on February 25, 2001, by Resolution No. 2001-14, the Planning Commission of the City of Azusa selected and designated the boundaries of the proposed areas to be added ("Added Areas") to the Central Business District Redevelopment Project, approved a Preliminary Plan for the Redevelopment of the Area Added to the Central Business District Redevelopment Project ("Preliminary Plan"), and authorized submission of the Preliminary Plan to the Azusa Redevelopment Agency ("the Agency"); and WHEREAS, on March 20, 2001, by Resolution No. 01-R7, the Agency received the Preliminary Plan and is preparing Amendments to the Redevelopment Plans for the Merged Central Business District Redevelopment Project and the West End Redevelopment Project ("Amendments") which would, among other things, add the Added Areas to the Central Business District Project, increase the financial limits in the plans, and adopt one amended and restated redevelopment plan applicable to both projects; and WHEREAS, the California Community Redevelopment Law (Health and Safety Code, Section 33000, et seq.) requires that if a project area committee does not exist, and an agency proposes to amend a redevelopment plan, the agency shall establish a project area committee if the proposed amendment would do any of the following: 1) Grant the authority to the agency to acquire by eminent domain property on which persons reside, and a substantial number of low- and moderate -income persons reside in the project area. 2) Add territory in which a substantial number of low- and moderate -income persons reside and grant the authority to the agency to acquire by eminent domain property on which persons reside in the added territory; 3) Add one or more public projects that will displace a substantial number of low-income persons or moderate -income persons, or both; and WHEREAS, the California Community Redevelopment Law also requires, that if the project area does not contain a substantial number of low- and moderate -income families whose residences would be subject to eminent domain, the agency shall consult with and obtain the advice of residents of community organizations, and further requires that the proposed amendment to the redevelopment plan be provided to such residents and community organizations prior to its submission to the city council; and WHEREAS, adoption and implementation of the proposed Amendments will not result in subjecting or re -subjecting properties within the existing Central Business District Redevelopment Project and the West End Redevelopment Project or the Added Areas to acquisition by the Agency through use of eminent domain authority; and Page 1 of 2 0 0 WHEREAS, because the Amendments will not add public projects that will displace a substantial number of low-income or moderate -income persons, adoption and implementation of the Amendments will not result in the displacement of a substantial number of low- and moderate -income persons, either through Agency property acquisition or through public projects implemented by the Agency. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AZUSA HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council finds and determines that the proposed Amendments to the Redevelopment Plans for the Merged Central Business District and West End Redevelopment Projects will not result in subjecting or re -subjecting properties within the existing Central Business District Redevelopment Project, the West End Redevelopment Project or the Added Areas in which a substantial number of low- and moderate -income persons reside to acquisition by the Redevelopment Agency of the City of Azusa with eminent domain authority, and that formation of a project area committee is not required for either or both projects or the Added Areas prior to the adoption of the Amendments. The City Council further determines that a project area committee or committees shall not be formed in connection with the Amendments. Section 2. The Redevelopment Agency of the City of Azusa is hereby authorized and directed to consult with and obtain the advice of residents, property owners, and community organizations (if any) within the existing Central Business District Redevelopment Project and the West End Project and areas to be added to the Central Business District Redevelopment Project and to provide such residents, owners and organizations with the proposed Amendments to the Redevelopment Plans prior to their submission to the City Council. PASSED, APPROVED and ADOPTI I HEREBY CERTIFY that the foregoing resolution was duly adopted by the City Council of Azusa at a regular meeting thereof, held on the7th day of May, 2001.
