HomeMy WebLinkAboutResolution No. 01-C0300 0 RESOLUTION NO. 01-C30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A PRECISE PLAN OF DESIGN NO. P-2001-02 TO CONSTRUCT TWELVE (12) INDUSTRIAL BUILDINGS AT 1004 W. TENTH STREET WHEREAS, an application was received from Net Development (Kevin Coleman) with respect to the requested Precise Plan of Design No. P-2001-02 to construct twelve (12) concrete tilt -up industrial buildings on twelve (12) individual lots at 1004 W. Tenth Street; and, and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on February 28, 2001 and has carefully considered all pertinent evidence and testimony, and WHEREAS, the City Council has held a duly noticed public hearing on March 20, 2001, and WHEREAS, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Precise Plan of Design No. P-2001-02, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: Pursuant to the California Environmental Quality Act Guidelines, a Negative Declaration has been prepared and reviewed finding that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said Negative Declaration. SECTION 2: That in accordance with Section 88-585 of the Azusa Municipal Code, it is found that the project would not unreasonably interfere with the use or enjoyment of property in the vicinity, and would not adversely affect the public peace, health, safety or general welfare, and provided the conditions of approval are adhered to, the City Council hereby approves said Precise Plan of Design based on the following findings: In accordance with Section 88-585 of the Azusa Municipal Code, it is found that the project would not unreasonably interfere with the use or enjoyment ofproperty in the vicinity and would not adversely affect the public peace, health, safety or general welfare in that the proposal is in conformance with the General Plan and is considered a permitted use in the district in which it is located. Most of the surrounding uses are industrial and partake in similar daily functions. Since the proposal is speculative in nature, each use to occupy the proposed buildings will be required to obtain, ata minimum, separate Cityapproval through Planning Division review and Building Division Certificate of Occupancy issuance. Furthermore, the project will be developed in accordance with all of the applicable provisions ofthe Zoning Code. All City divisions and departments have indicated the ability to support the development and have issued standard conditions of approval. Page 1 of 2 0 0 Resolution No. 01-r30 P-2001-02 SECTION 3: Based on the aforementioned findings, the City Council does hereby approve of Precise Plan of Design No. P-2001-02, for the property located at 1004 W. Tenth Street, subject to the conditions of approval attached hereto as Exhibit A, and incorporated herein by reference, as though set out in full and at length. SECTION 4. The City Clerk shall certify to the passage of this resolution and shall cause the same to be published in compliance with Chapter 88, Article III, Division 13 of the Azusa Municipal Code. The Precise Plan of Design shall become effective and a building permit may be issued only after these findings and conditions have been accepted in writing by the owner of the described property. SECTION 5: The Secretary shall certify to the adoption PASSED, APPROVED AND ADOPTED this 20 day of , A -UH / , 2001.
