RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING TENTATIVE PARCEL MAP NO. 26234 TO SUBDIVIDE ONE (1) PARCEL OF LAND INTO TWELVE (12) PARCELS AT 1004 W. TENTH STREET WHEREAS, an application was received from Net Development with respect to the requested Tentative Parcel Map No. 25234, to subdivide one (1) parcel of land into twelve (12) parcels at 1004 W. Tenth Street; and WHEREAS, the Planning Commission considered this request in a duly noticed public hearing on February 28, 2001 and has carefully considered all pertinent evidence and testimony, and WHEREAS, the City Council has held a duly noticed public hearing on March 20,200 1, and WHEREAS,, the City Council of the City of Azusa carefully considered all the pertinent evidence and testimony regarding Tentative Parcel Map No. 26234. THE CITY COUNCIL OF THE CITY OF AZUSA HEREBY RESOLVES AS FOLLOWS: SECTION 1: The City Council of the City of Azusa determines and declares the following Finding of Fact: A. That in accordance with Section 88-585 of the Azusa Municipal Code, it is found that the project would not unreasonably interfere with the use or enjoyment of property in the vicinity, and would not adversely affect the public peace, health, safety or general welfare in that the proposed subdivision is in conformance with the City's General Plan and Zoning Code. The project has met the State's CEQA guidelines for environmental review and is consistent with the Subdivision Map Act. Furthermore, the City Engineer has reviewed the proposal and consented to its approval. SECTION 2: Pursuant to the City of Azusa CEQA implementing procedures and the State of California's CEQA guidelines, a Negative Declaration has been prepared, noticed, and reviewed, finding that the proposed project will not have a significant impact on the environment. The City Council hereby certifies said Negative Declaration. SECTION 3. The City Council hereby approves Tentative Parcel Map No. 26234 based on the aforementioned findings and conditions of approval listed as Exhibit A. The map shall be finalized and recorded prior to any construction and only after these findings and conditions have been accepted in writing by the owner of the described property. SECTION 4. The City Clerk shall certify to the passage of this resolution and shall 0 0 Resolution No. 01—C29 Page 2 of 2 cause the same to be published in compliance with Chapter 66, Article IV, Division 4 of the Azusa MunicinaLCode. 0 MAYOR CITY CLERK 0 day of MARCH 2001.
