HomeMy WebLinkAboutResolution No. 01-C0280 0 RESOLUTION NO. PI -C28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A VARIANCE NO. V-2000-09 TO ALLOW TANDEM PARKING AT 720 E. FOOTHILL BOULEVARD WHEREAS, the Planning Commission of the City of Azusa, has given notice thereof as required by law, held a public hearing on February 14, 2001, for the application of Richard J. Brooks, with respect to the requested Variance No. V-2000-09, to allow tandem parking for the proposed banquet facility, located at 720 E. Foothill Boulevard; and WHEREAS, the Planning Commission considered all pertinent testimony and the staff report offered in the case as presented at the public hearing. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: Pursuant to the California Environmental Quality Act Guidelines, a Negative Declaration has been prepared and reviewed finding that the proposed project could not have a significant effect on the environment. The City Council hereby certifies said Negative Declaration. SECTION 2: That in accordance with Section 88-585 of the Azusa Municipal Code, it is found that the project would not unreasonably interfere with the use or enjoyment of property in the vicinity, and would not adversely affect the public peace, health, safety or general welfare, and provided the conditions of approval are adhered to, the City Council hereby approves said Variance based on the following findings: A. THAT THE STRICT APPLICATION OF THIS CHAPTER WOULD RESULT IN PRACTICAL DIFFICULTIES OR UNNECESSARY HARDSHIPS INCONSISTENT WITH THE GENERAL PURPOSE AND INTENT OF THIS CHAPTER. The intent ofthe banquet facility is to complement the adjacent Lindley Scott Carriage House and the surrounding area, which is valued by the community as an important aesthetic area. Strict application of the zoning code would necessitate either construction of a large parking lot or a parking structure to meet the required number of spaces. Requiring a large parking lot or structure would not complement the adjacent environment, but would degrade the existing aesthetic setting of the area by resulting in less landscaped area and area left as open space or, in the case of a parking structure, a building that is aesthetically incompatible with the surrounding area. Page 1 of 4 0 Resolution No. 01— 2 8 V-2001-09 Given that the banquet facility will be used to host weddings and receptions, which are held in this area because of its aesthetic qualities, diminishing the aesthetic quality and compatibility with the surrounding area would result in an unnecessary hardship to the property. The variance to allow tandem parking on the site will allow the banquet facility and parking lot to better complement the surrounding environment, while still providing the number ofparking spaces required by the zoning code. B. THAT THERE ARE EXCEPTIONAL CIRCUMSTANCES OR CONDITIONS APPLICABLE TO THE PROPERTY INVOLVED OR THE INTENDED USE OR DEVELOPMENT OF THE PROPERTY DOES NOT APPLY GENERALLY TO OTHER PROPERTY IN THE SAME ZONE OR NEIGHBORHOOD. The Lindley Scott Carriage House is a unique feature in the City not found near other properties or neighborhoods with similar zoning. As such, development should be geared towardpreserving the existing character ofthe area. Thevariance topermittandemparking will allowfor development that is consistent with the character ofthe Lindley Scott Carriage House, as the size and scale of the parking area can be reduced with the granting of the variance, allowing more of the site area to be preserved or landscaped to match the surrounding area. C. THAT THE GRANTING OF SUCH A VARIANCE WILL NOT BE MATERIALLY DETRIMENTAL TO THE PUBLIC WELFARE OR INJURIOUS TO PROPERTY OR IMPROVEMENTS IN THE ZONE OR NEIGHBORHOOD IN WHICH THE PROPERTY IS LOCATED. Allowing tandem parking for the banquet facility will not harm other property owners nor be detrimental to the public welfare. Rather, the granting of the variance will be a benefit to the neighborhood as the smallerparking area allows for more of the existing environment to be preserved. Granting the variance will not lead to parking problems on thesite or with adjacent property owners, as the required number of parking spaces will be provided. In addition, parking attendants will be used on the site to assist in the parking operations. D. THAT THE GRANTING OF SUCH A VARIANCE WILLNOT BE CONTRARY TO THE OBJECTIVE OF ANY PART OF THE GENERAL PLAN. Page 2 of 4 0 0 Resolution No. 01 _ C 2 8 V-2001-09 The granting of this variance is not contrary to any objective or part of the General Plan. The variance will further Community -Wide Land Use Goal 2: "Ensure that the type, amount design, and pattern of all land uses throughout the City and planning area serve to protect and enhance the character of Azusa as a desirable residential urban community." In addition, the variance is consistent with the General Plan commercial uses objective "to ensure adequate parking, attractive landscape and architectural design, and good access to the commercial area from its service area. " SECTION 3: Based on the aforementioned findings, the City Council does hereby approve of Variance No. V-2000-09, for the property located at 720 E. Foothill Blvd, subject to the conditions of approval attached hereto as Exhibit A, and incorporated herein by reference, as though set out in full and at length. SECTION 4: The City Clerk shall certify to the passage of this resolution and shall cause the same to be published in compliance with Chapter 88, Article III, Division 13 of the Azusa Municipal Code. The Variance shall become effective and a building permit may be issued only after these findings and conditions have been accepted in writing by the owner of the described property. SECTION 5: The Secretary shall certify to the adoptiorp,A.f this resolution. PASSED, APPROVED AND ADOPTED this 20 day CHI , 2001.
