RESOLUTION NO. 01-C27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING A
CONDITIONAL USE PERMIT NO. C-2000-08 TO ALLOW ON -SALE BEER AND
WINE IN CONJUNCTION WITH A BANQUET FACILITY AT 720 E. FOOTHILL
BOULEVARD
WHEREAS, the Planning Commission of the City of Azusa, has given notice thereof as
required by law, held a public hearing on February 14, 2001, for the application of Richard J.
Brooks, with respect to the requested Conditional Use Permit No. C-2000-08, to allow on -sale beer
and wine in conjunction with a banquet facility located at 720 E. Foothill Boulevard; and
WHEREAS, the Planning Commission considered all pertinent testimony and the staff
report offered in the case as presented at the public hearing.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
AZUSA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1: Pursuant to the Cali forma Environmental Quality Act Guidelines, aNegative
Declaration has been prepared and reviewed finding that the proposed project could not have a
significant effect on the environment. The City Council hereby certifies said Negative Declaration.
SECTION 2: That in accordance with Section 88-585 of the Azusa Municipal Code, it is
found that the project would not unreasonably interfere with the use or enjoyment of property in the
vicinity, and would not adversely affect the public peace, health, safety or general welfare, and
provided the conditions of approval are adhered to, the City Council hereby approves said
Conditional Use Permit based on the following findings:
A. THAT THE PROPOSED CONDITIONAL USE IS CONSISTENT WITH THE GENERAL
PLAN.
The proposal does not conflict with the General Plan in that it consists of an additional
service with a proposed banquet hall in a commercial zone. The General Plan does not
distinguish among items sold within a commercial business. Furthermore, the General Plan
is not specific to the issues of regulating alcohol uses but refers to the City's zoning
ordinance for control measures.
B. THAT THE NATURE, CONDITION, AND DEVELOPMENT OF THE ADJACENT
USES, BUILDINGS, AND STRUCTURES HAVE BEEN CONSIDERED, AND THE USE
WILL NOT ADVERSELY AFFECT OR BE MATERIALLY DETRIMENTAL TO THESE
ADJACENT USES, BUILDINGS, OR STRUCTURES.

The uses directly adjacent to the subjectproperty are institutional to the north (Azusa Pacific
University West Campus), multiple family residential to the south, a single-family dwelling
to the east, and a motel (All 8 motel) and a duplex unit to the west. The proposal will exceed
the ratio of on-site licenses to population in the census tract in which the banquet hall will
be located. However, beer and wine will only be offered with meals and will be a minor portion of
the banquet hall's anticipated sales. It is furthermore found that the inclusion of beer and wine will
represent a public convenience for the patrons of this business.
C. THAT THE SITE IS OF ADEQUATE SIZE AND SHAPE TO ACCOMMODATE THE
USE, BUILDINGS, YARDS, FENCES AND WALLS, PARKING, LANDSCAPING, AND
OTHER DEVELOPMENT FEATURES PROPOSED.
A Development Review Board meeting was held to receive comments from City
departments/divisions. Standard conditions and requirements were given by the various
departments. Theproject meets all of the applicable provisions of the Azusa Municipal Code
to accommodate the use, buildings, yards, fences and walls, parking, landscaping, and other
development features proposed.
D. THAT THE PROPOSED CONDITIONAL USE COMPLIES WITH ALL OF THE
APPLICABLE DEVELOPMENT STANDARDS OF THE ZONE DISTRICT.
The proposal meets all of the applicable standards of the C-2 district in which it is located.
Staff has analyzed each development standard and prepared a Zoning Conformance Table
to show compliance. This table has been included as part of the Planning Commission staff
report.
E. THAT THE SITE IS ADEQUATELY SERVED BY HIGHWAYS OR STREETS OF
SUFFICIENT WIDTH AND IMPROVED AS NECESSARY TO ACCOMMODATE THE
TYPE OF TRAFFIC ASSOCIATED WITH THE PROPOSED USE.
The property is located on a major arterial street, Foothill Blvd. The site has access from
Foothill Blvd. and RockvaleAvenue through a shared driveway with Alla motel. Theon -site
consumption should not generate any additional traffic since alcoholic beverages will be
served in conjunction with privately scheduled events. Based on street capacity, proposed
parking lot and site access, traffic created during the privately scheduled events should not
be significant.
F. THAT THE PROPOSED CONDITIONAL USE OBSERVES THE SPIRIT AND INTENT
OF THE ZONING ORDINANCE.

The intent of the zoning ordinance is to address all relevant issues pertaining the sale and/or
consumption of alcoholic beverages, determine potential impacts and impose the necessary
conditions to prevent the impacts and/or mitigate them to a level of insignificance.
Conditions of approval have been included to observe the intent of the Zoning Ordinance.
SECTION 3: Based on the aforementioned findings, the City Council does hereby approve
of Conditional Use Permit No. C-2000-08, for the property located at 720 E. Foothill Blvd, subject
to the conditions of approval attached hereto as Exhibit A, and incorporated herein by reference, as
though set out in full and at length.
. SECTION 4: The City Clerk shall certify to the passage of this resolution and shall cause
the same to be published in compliance with Chapter 88, Article III, Division 13 of the Azusa
Municipal Code. The Conditional Use Permit shall become effective and a building permit may be
issued only after these findings and conditions have been accepted in writing by the owner of the
described property.
SECTION 5: The Secretary shall certify to the adoption
