HomeMy WebLinkAboutResolution No. 02-C052RESOLUTION NO. 01-052 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "ANNEXATION NO. 00-C7 TO THE CITY OF AZUSA" AND DETACHMENT FROM THE LOS ANGELES COUNTY PUBLIC LIBRARY .AND LOS ANGELES COUNTY ROAD DISTRICT NO.5 WHEREAS, pursuant to Sections 99 of the Revenue and Taxation Code, for specified jurisdictional changes, the governing bodies of an affected County and City shall negotiate and determine the amount of property tax revenue to be exchanged between the affected agencies; and WHEREAS, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Azusa have determined that the.amount of property tax revenue to be exchanged between their respective agencies as a result of 1he annexation of unincorporated territory to the City of Azusa identified as "Annexation No. 00-C7 to the City of Azusa" and detachment from the County Library District and Road District No. 5, is as set forth below. NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Auditor -Controller of the County of Los Angeles shall establish one or more separate tax rate areas (TRA) for the area subject to the jurisdictional change referred to as Annexation No. 00-C7 to the City of Azusa. 2. The area within Annexation No. 00-C7 to the City of Azusa is currently within the jurisdiction of the Consolidated Fire Protection District and shall remain so and the Consolidated Fire Protection District shall continue to receive its share of property tax revenues as designated in Annexation No. 00-C7 to the Upper San Gabriel Valley 0 Municipal Water District. 3. The negotiated exchange of property tax revenues between the County of Los Angeles and the City of Azusa from Annexation No. 00-C7 to the City of Azusa is approved . . and accepted. 4. For fiscal years commencing on or after July 1, 2002; or the July 1 after the effective date of this jurisdictional change, whichever is later, Three Huridred, Sixty -Eight Dollars ($368) in property tax revenue shall be transferred from the County of Los Angeles to the City of Azusa, California. 5. For fiscal years commencing on or after July 1, 2002, or the July 1 after the effective date of this jurisdictional change, whichever is later, .102562429 percent of the annual property tax growth attributable to Annexation No. 00-C7 to the City of Azusa shall be transferred from the County of Los Angeles to the City of Azusa, and the County s share of incremental growth shall be reduced accordingly. 6. For fiscal years commencing on or after July 1, 2002, or the July 1 after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by the Los Angeles County Public Library attributable to Annexation No. 00-C7 to the City of Azusa shall be transferred to the County of Los Angeles. 7. For fiscal years commencing on or after July 1, 2002, or the July 1 after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by County Road District No. 5 attributable to Annexation No. 00-C7 to the City of Azusa shall be transferred to the County of Los Angeles. 8. If at any time after the approval of this resolution, the City of Azusa exercises its option to terminate its contract with the Consolidated Fire Protection District such that the area within Annexation No. 00-C7 to the City of Azusa is detached from that entity, an amount of the property taxes received by the Consolidated Fire Protection District from properties within the area of Annexation No. 00-C7 to the City of Azusa shall be transferred to the City of Azusa in order to increase the City of Azusa's share of the property tax in the subject area from:.102562429 to .162875891, and the balance of the property taxes previously allocated to the Consolidated Fire Protection District shall be transferred to the County of Los Angeles and the County of Los Angeles' share of theproperty tax in the area of Annexation No. 00-C7 to the City of Azusa shall be increased accordingly. 9. In the event that all or a portion of the annexation area is included within a redevelopment project pursuant to California Community Development Law, Health & Safety Code Sections 33.000 et seq., the City of Azusa shall not adopt the ordinance approving the redevelopment plan with respect to the annexed area until such time as the Redevelopment Agency of the City of Azusa has diligently and in good faith complied with. all applicable provisions of the California Community Development Law, including but not limited to Health & Safety Code Section 33670 or any other relevant provision of law. Any ordinance approving a redevelopment project which does not comply with this paragraph shall be void and of no effect with regard to the subsequent allocation and distribution of taxes to the Redevelopment Agency. 0 r PASSED APPROVED AND ADOPTED this 6th day Of May 2001 by the following vote: AYES: HARDISON,STANFORD, ROCNA,CHAGNON,MADRID NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST:.
