RESOLUTION NO. 02-C83
AN RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AZUSA APPROVING VESTING TENTATIVE TRACT MAP 52992
FOR PROPERTIES DESIGNATED AS ASSESSOR PARCEL
NUMBER 8615-016-900 AND ASSESSOR PARCEL NUMBER
8615-016-901, LOCATED AT 1010 WEST FIRST STREET
WHEREAS, the City Council of the City of Azusa, has given notice thereof as
required by law, held a public hearing on the application for a vesting Tentative Tract Map
52992 for properties designated as APN Nos: 8615-016-900, and 901.
WHEREAS, required notice was mailed as set forth in affidavits on file at the
Community Development Department not less than ten days prior to the date of the
hearing in compliance with City Code Section 88-125, 88-130, 88-135, and 88-140, and
Government Code section 65090 and 95091.
WHEREAS, the City prepared the Initial Study and Mitigated Negative Declaration
in accordance with CEQA, the State CEQA Guidelines, and the City's CEQA implementing
procedures, and that the Planning Commission has reviewed and considered the
Mitigated Negative Declaration and the comments received thereon,
WHEREAS, the City published a notice of its intention to adopt the Mitigated
Negative Declaration in compliance with Public Resources Code section 21092 in the
Azusa Herald on June 27, 2002, which notice also included a notice of the public
hearings before the City Council on August 5, 2002.
WHEREAS, the Planning Commission held a duly noticed public hearing on July 10,
2002, on the Project Approvals, and duly considered all information presented to it.
WHEREAS, after due deliberation and consideration of the Initial Study and
Mitigated Negative Declaration, the Planning Commission voted to recommend that the
City Council adopt the Mitigated Negative Declaration, and further recommended that
the City Council approve the Project Approvals.
WHEREAS, pursuant to Ordinance Number 99-018, the City Council of the City of
Azusa may, by resolution adopted by a four-fifths vote of its membership, determine
that public convenience and necessity will be served by the acquisition, construction and
maintenance of a street less than 40 feet wide.
THE CITY COUNCIL OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1: Pursuant to the City of Azusa Local Guidelines for implementing
CEQA and the State CEQA guidelines, a Mitigated Negative Declaration has been

prepared and reviewed, finding that the proposed project could not have a significant
effect on the environment. The City Council hereby certifies said Mitigated Negative
Declaration, with the provision that the mitigation measures recommended in the
initial study be implemented.
SECTION 2: That in accordance with Section 66-178 of the Azusa Municipal
Code, it is found that the project would not unreasonably interfere with the use or
enjoyment of property in the vicinity, and would not adversely affect the public peace,
health, safety or general welfare, and provided the conditions of approval are adhered to,
the City Council hereby approves adoption of said Vesting Tentative Tract Map based on
the following findings:
A. Such approval will not be materially detrimental to the public welfare, injurious
to the property or improvements in the vicinity and zone in which the land is
located, will not be contrary to or adversely affect the general comprehensive
zoning plan for the city.
With approval of the proposed General Plan Amendment, the Vesting Tentative
Tract Map is consistent with the City of Azusa General Plan, which includes the
requirements of the Seismic Safety/Public Safety Element and the Noise Element.
The proposed residential project will be constructed to meet the development
standards of the zone and the Uniform Building Code standards. The proposed
street widths will be allowed with a 4/5 majority vote of the City Council.
B. Proper or adequate provision has been made for access to the land to be sold,
divided or subdivided and also the portion of land remaining or that access to
the land is by means of dedicated streets of a sufficient width and state of
improvement to adequately serve the land described in the application.
Access to the park and residential parcels created by the Vesting Tentative Tract
Map would be provided by the construction of B" "C" and "D" Streets and
the construction of the extensions of Parkside Street and Jackson Avenue.
C. Proper and adequate provisions have been made for all public utilities and
public services, including sewers.

easements.
SECTION 3. The City Council hereby approves Vesting Tentative Tract Map 52992
merging Assessors Parcel Number 8615-016-900 and Assessors Parcel Number 8615-
016-90 and subdividing the created parcel into 28 residential lots and 2 park lots for the

expansion of Zacatecas Park.
SECTION 4. The City Clerk shall certify to the passage of this resolution and shall
cause the same to be published in compliance with Chapter 88, Article 11, Division 5 of
the Azusa Municipal Code.
